Patna Court Sentences Man to Two Years in Prison for Triple Talaq Violation Under Muslim Women Act, 2019

The CSR Journal Magazine

A Patna court has sentenced a man to two years of rigorous imprisonment for the instant pronouncement of triple talaq on his wife. The ruling was delivered by Additional District and Sessions Judge Rajiv Ranjan Sahay on Thursday, marking a significant legal development under the Muslim Women (Protection of Rights on Marriage) Act, 2019. The accused, Naushad Ahmed, was convicted for violating this law, as well as for offences under sections 323 and 341 of the Indian Penal Code, which pertain to voluntarily causing hurt and wrongful restraint.

In addition to the prison sentence, the court imposed a fine of Rs 6,500 on Ahmed. If he fails to pay this fine, he faces an additional one month and 22 days in prison. However, the court acquitted him of charges related to an alleged acid attack on his wife, which had been part of the initial complaint.

Background of the Incident

The case originated from a First Information Report (FIR) filed at the Phulwari Sharif police station in September 2022. According to the complaint, Ahmed, a resident of Simri village, pronounced triple talaq on his wife on September 5, 2022. The couple had been married for nearly 21 years and had three children together. The complainant alleged that Ahmed not only assaulted her but also threatened to throw acid on her, which contributed to the seriousness of the charges against him.

The police conducted an investigation and filed a chargesheet on July 31, 2023, detailing the allegations. The case has drawn attention due to its implications for the enforcement of the Muslim Women (Protection of Rights on Marriage) Act, which aims to protect women from arbitrary divorce practices.

Ahmed’s lawyer, Shekhar Kumar, stated that the prosecution had not sufficiently proven the allegations regarding the acid attack. He expressed concerns about the conviction on the other charges and mentioned that his client, who is currently out on bail, intends to appeal the verdict in the high court.

Legal Framework and Implications

The Muslim Women (Protection of Rights on Marriage) Act, 2019, was enacted to declare instant triple talaq void and illegal, providing for a maximum imprisonment of three years and a fine for offenders. The Lok Sabha passed the bill on July 25, 2019, followed by approval from the Rajya Sabha on July 30. The law came into effect retrospectively from September 19, 2018, aiming to safeguard the rights of Muslim women in marital matters.

This case marks a notable instance of legal action being taken under the new law in Patna district, as it is reportedly the first time a sentence has been pronounced for a triple talaq offence in this jurisdiction. The court’s decision is expected to set a precedent for similar cases in the future, reinforcing the legal framework established by the 2019 Act.

As the legal proceedings continue, the implications of this case may resonate beyond the immediate parties involved, potentially influencing public discourse on the rights of women within the Muslim community and the enforcement of laws designed to protect them.
