Justice for 5-Year-Old: Court Sentences Two to Death for Brutal Assault and Murder

In the case of sexual assault, abduction and murder of a 5-year-old girl, two men named Amit and Nikhil have been given the death sentence by a special POCSO court. This verdict was delivered by Special Judge Sonika Chaudhary (ADJ-27). While pronouncing the judgment, Chaudhary said the crime has deeply disturbed the social conscience and hence maximum punishment is given.

The disturbing incident happened on March 18, 2024. The 5-year-old girl was playing near her home when she was abducted by the two. Assistant District Government Counsel (Crime) Subhash Giri, who prosecuted the case, shared, “The complainant’s five-year-old daughter was playing near the village canal. From there, she was taken away by the accused, Amit and Nikhil, on a motorcycle after luring her. After that, they committed brutal sexual assault on her, both natural and unnatural. They inflicted multiple injuries all over her body, and later murdered her in a gruesome manner.”

On March 19, post the abduction and rape, the duo called the victim’s father and asked for a ransom of Rs 6 lakh. During the proceeding, Giri explained, “Tracking the phone call, the accused were held on March 20 and later they confessed and disclosed where the body of the girl was.”

It was confirmed after the postmortem that there were multiple injuries and sexual assault. Chargesheet was filed within 25 days of the heinous act. The case was filed under IPC Sections 363 (kidnapping), 364A (kidnapping for ransom), 302 (murder), 201 (causing disappearance of evidence), and 376 (rape), along with Sections 5M/6 and 5G/6 of the POCSO Act.

Giri further shared that during the trial 18 witnesses were present in total and evidence clearly confirmed the act, and after examination, the duo was awarded the death penalty. “I am deeply thankful to the Hon’ble Court for delivering such a strong and just judgment in this matter,” said Giri.

After the verdict came, the victim’s mother said, “Had they remained alive, who knows how many more would have suffered?”
