Delhi HC Defers Hearing on Journalist’s Protection Plea in Caste Remarks Case

The CSR Journal Magazine

The Delhi High Court has postponed an urgent hearing regarding a plea from an independent woman journalist seeking protection from coercive action in a case involving allegations of casteist remarks against a police officer. The court has scheduled the matter for hearing on Friday. This decision comes in light of a complaint made by Assistant Commissioner of Police Vivek Bhagat, who alleged that the journalist publicly humiliated him during a protest near Jantar Mantar earlier this month.

Background of the Case

The case was initiated following a protest that took place on October 3, where Bhagat claimed that he overheard the journalist making derogatory comments about his caste, Megh or Meghwal, and questioned his appointment as an Assistant Commissioner of Police. Bhagat, who was on law-and-order duty at the time, stated that he ignored the remarks and continued with his responsibilities. However, he also alleged that the journalist accused him of sexual assault during the handling and detention of protesters, confronting him repeatedly alongside her colleagues.

In response to Bhagat’s complaint, the Delhi Police registered a first information report (FIR) against the journalist and others. The FIR cites relevant provisions of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, as well as Sections 221, 356(2), and 3(5) of the Bharatiya Nyaya Sanhita, which pertain to obstructing a public servant from performing their duties, defamation, and common intention. The allegations have raised significant legal and social implications regarding caste-based discrimination and the treatment of public officials.

The journalist’s counsel sought an urgent hearing, emphasising the need for immediate protection from coercive action, given the serious nature of the allegations. The bench, comprising Acting Chief Justice Nitin Wasudeo Sambre and Justice Sanjay Sharma, acknowledged the request but opted to defer the hearing until the following day. The counsel expressed concerns regarding the potential repercussions of the FIR, stating, “My interim prayer is for protection from coercive action. That is why I request a hearing today. There is a strong apprehension.”

Social Media Allegations

In addition to the allegations made by Bhagat, it has been reported that the journalist and several members of the Cockroach Janta Party, including Abhijeet Dipke, Ashutosh Ranka, Saurav Das, and Ratna Singh, circulated posts and reels on social media platforms X and Instagram, accusing Bhagat of misconduct. This aspect of the case highlights the role of social media in contemporary legal disputes, particularly in matters involving public figures and allegations of misconduct.

The ongoing investigations into both the FIR against the journalist and her prior sexual assault complaint against Bhagat are critical to understanding the broader context of this case. The High Court’s decision to hear the plea for protection on Friday will be pivotal in determining the next steps for all parties involved. The legal proceedings are expected to draw significant attention, given the sensitive nature of the allegations and the implications for both the journalist and the police officer.

As the situation develops, the Delhi High Court’s forthcoming hearing will be closely monitored by various stakeholders, including legal experts, journalists, and advocates for social justice. The outcome may have lasting effects on the discourse surrounding caste discrimination and the rights of individuals in similar situations.
