CK Hutchison Pursues $1.5 Billion Compensation from Panama Over Port Seizures

CK Hutchison, a Hong Kong-based conglomerate, announced on Thursday its intention to seek over $1.5 billion in compensation from Panama due to the government’s seizure of two significant canal ports. The company has initiated arbitration proceedings, claiming that Panama violated an investment protection treaty through a series of “sovereign acts” aimed at its long-held concessions.

The ports in question, Balboa and Cristobal, were taken over by the Panamanian government in February, following a ruling from the country’s Supreme Court that deemed CK Hutchison’s subsidiary’s concession unconstitutional. This legal decision has intensified existing tensions, particularly in the context of US-China relations.

CK Hutchison alleges that the actions taken by Panama constitute a state-sponsored attack on its assets and have raised concerns about the protection of foreign investments in the region. In addition to arbitration against the Panamanian government, CK Hutchison initiated proceedings against Danish shipping giant Maersk after it assumed control of certain port operations in Panama. Maersk has countered that it does not accept liability regarding these claims, adding another layer of complexity to the unfolding legal landscape.

The conglomerate now finds itself entangled in multiple legal disputes surrounding its interests in Panama.
