Aishwarya and Abhishek Bachchan sue YouTube, demand Rs 4 crore for tarnishing their image through deepfake videos

The CSR Journal Magazine

Bollywood starts Abhishek Bachchan and Aishwarya Rai Bachchan have sought Rs 4 crore from Google over their “personality rights”. Bollywood stars have lately been alleging that their pictures and videos are being used everywhere for sexual purposes. As a result, their public image and reputation is being tarnished.

Star couple Abhishek Bachchan and Aishwarya Rai Bachchan recently approached the Delhi High Court to avoid facing such an unpleasant experience in the future. The couple have filed separate lawsuits in the Delhi High Court against YouTube and its parent company Google.

According to court filings as reported by Reuters, the star couple is seeking $450,000 (approximately Rs 4 crore) in damages, along with a permanent injunction to stop YouTube from hosting or monetising any content that misrepresents them or misuses their voices, likeness, and images in AI-generated deepfake videos.

The couple reportedly appealed to the judge to remove and prohibit creation of AI videos infringing their intellectual property rights. They also want Google ordered to have safeguards to ensure such YouTube videos uploaded anyway do not train other AI platforms, as per Reuters reports.

Reports further claim that the actors argue that YouTube’s content and third-party training policy is concerning as it lets users consent to sharing of a video they created to train rival AI models, risking further proliferation of misleading content online.

In the era of Artificial Intelligence, creating various content by distorting the faces and voices of stars has become a common practice. It is alleged that various items like coffee mugs and T-shirts have been created using Abhishek-Aishwarya’s pictures. At the same time, various distorted intimate pictures of the actress created with AI have been shared on internet.

AI Generate deepfake video shows Salman-Aishwarya having dinner

The 1500-page charge sheet submitted to the court contains links to various anonymous websites and YouTube, in which the Bachchan couple’s faces are clearly visible. What is there in that content? According to Bollywood media sources, in the links submitted to the court, sometimes Salman-Aishwarya are seen having dinner together using artificial intelligence, and sometimes Abhishek Bachchan is reportedly seen kissing another woman on the cheek!

The Delhi High Court has ruled in favour of Abhishek-Aishwarya so that no one can create such ugly content with the help of AI just to garner views on their platform.

Links to 518 websites to be removed: Delhi HC

The court has already ordered the removal of links to 518 websites in September. The website links and posts specifically listed by the actors to be taken down, as they caused financial harm to the couple and harmed their dignity and goodwill, stated the court.

The court recently informed that such misuse of artificial intelligence has not only caused financial loss to the Bachchans, but also an attempt has been made to tarnish their reputation, which also affects the right of a person to live with dignity. Moreover, if a star’s face is used in an advertising image or video without permission, consumers may also be confused. The court further stated that such manipulation of artificial intelligence violates the personal rights of the stars.

Now, Aishwarya-Abhishek have asked Google for 4 crores, alleging that their image has been tarnished. the Bachchans’ lawsuits are the most high-profile to date about the interplay of personality rights and the risk that misleading or deepfake YouTube videos could train other AI models. The Delhi High Court last month asked Google’s lawyer in court to submit written responses before the next hearing on January 15.
