The Supreme Court on Tuesday exercised its extraordinary powers under Article 142 of the Indian Constitution to quash all First Information Reports (FIRs) that were filed against youth protesters. These protests took place from July 20 to July 25 during the Cockroach Janta Party-led demonstrations against the National Eligibility cum Entrance Test (NEET). The protesters had been demanding the resignation of then Union Education Minister Dharmendra Pradhan.

The court’s ruling stated that any other FIRs linked to the same events in any Indian state or Union Territory should not be pursued. Thus, these cases are officially closed for all purposes as per the judgement delivered by the bench.

This decision comes as a significant legal precedent and emphasises the court’s role in protecting citizens’ rights when they participate in protests and demonstrations. By using its special powers, the Supreme Court underscores the balance between state actions and civil liberties.

Status of Existing FIRs and Future Actions

Moreover, the Supreme Court clarified that the FIRs under consideration were not only quashed for the states that filed the application but extended to all jurisdictions. This means that no additional FIRs can be registered for incidents arising from the protests conducted within the specified dates. The court aimed to prevent any further legal action against those involved in the protests during that period.

The ruling appears to provide relief to many young individuals who had participated in these anti-NEET protests, which garnered widespread attention. In light of this decision, proponents of the movement are now looking forward to continuing their advocacy without the looming threat of legal repercussions.

The court’s directive may also serve to set a standard for handling future protests, especially those involving youth. By prohibiting new FIRs on similar grounds, the Supreme Court has made it clear that the right to protest shall not be curtailed by punitive legal actions.
