“Out Of Line”: CJI Kant Reprimands Man For Calling His Brother Over Court Proceedings

The CSR Journal Magazine

Chief Justice of India Surya Kant expressed strong disapproval on Wednesday during an open court session, addressing a litigant after learning that the man’s father had allegedly made a phone call to the Chief Justice’s brother to question an order issued by the Supreme Court. This confrontation raised questions surrounding the integrity of court proceedings. The episode centered on a petition concerning reserved seats for admission to a minority educational institution.

During the proceedings, CJI Surya Kant inquired why contempt proceedings should not be initiated against the petitioner’s father due to this incident. He remarked on the gravity of the situation, stating, “He calls up my brother and asks him how the Chief Justice of India has passed this order.” When the counsel for the petitioner claimed ignorance about the phone call, CJI Surya Kant advised him to investigate the matter thoroughly. The Chief Justice indicated that such actions constitute blatant misconduct.

Responding to the lack of awareness regarding the father’s actions, the petitioner’s counsel offered an apology. However, CJI Surya Kant reiterated the seriousness of the matter, asserting, “Nobody dares to do this. And you think I will transfer the case because of this? I have dealt with such elements for the last 23 years.” His remarks underscored the judiciary’s commitment to upholding its authority in the face of perceived misconduct.

Case Details and Background of the Petition

The case in question involves a petition filed by Nikhil Kumar Punia, who was born into an upper-caste Hindu family but reportedly converted to Buddhism. Along with another candidate from the General Category, Punia seeks minority reservation benefits for admission to a Buddhist medical college, citing their claims of conversion as the basis for their request. However, this case has drawn scrutiny from the court regarding the authenticity of their claims.

In January, during an initial hearing, the Supreme Court bench led by CJI Surya Kant expressed significant skepticism about the validity of the petitioners’ assertions of conversion. The court mandated an investigation into the authenticity of their minority certificates, indicating that the claims might involve fraudulent elements. The bench characterized the situation as a “new type of fraud.”

This incident further emphasizes the importance of maintaining the dignity of court proceedings and respecting the judicial process. CJI Surya Kant’s remarks serve as a reminder of the judiciary’s role in safeguarding its integrity against any external pressures or misconduct.
