IT Department Initiates Nationwide Investigation into Foreign Remittances

The Income Tax Department has begun a nationwide verification initiative concerning questionable foreign remittances. This move comes after the department identified certain entities that allegedly remitted substantial sums overseas while reporting minimal or no business activity. The announcement was made on X, detailing how the department recognised significant remittances that seemed inconsistent with the financial activities reported by the entities involved.

This verification exercise, which started on August 18, relies on a combination of data analysis and intelligence gathered on the ground. The department is scrutinising the entities responsible for these transactions, as well as the individuals behind them and the professionals who certified the transactions.

Concerns Arising from Data Analysis

The investigation was prompted by findings indicating that various entities had made considerable remittances over the last three years. Some of these entities reportedly failed to file income tax returns or declared very low turnover figures that did not align with the large sums being transferred abroad. The discrepancies raised alarms within the Finance Ministry, prompting a thorough review.

Furthermore, the stated purposes for certain remittances—including payments for freight, software imports, and consulting services—were deemed inconsistent with the entities’ actual commercial activities. Field verifications suggested that some entities might not even operate from the addresses they had officially declared.

In addition to these concerns, the investigation has revealed a connection to fictitious charitable trusts, which allegedly participated in facilitating bogus donations. This search operation unveiled a more extensive network of entities engaged in remitting funds internationally, further complicating the situation.

Focus on Certification and Professional Diligence

The Income Tax Department’s findings highlight the issuance of Form 15CB certificates by a limited group of professionals. Form 15CB is pivotal for specific foreign remittances and mandates that accountants assess the taxability based on the taxpayer’s financial records. The department’s investigation raised serious concerns about whether adequate diligence and scrutiny were exercised prior to issuing these certificates.

As per the new income tax regulations, the equivalent provision involves Form 146 in conjunction with Rule 220 of the Income-tax Rules, 2026. The ongoing investigation encompasses approximately 394 entities, including 117 located in land-border states, and 36 professionals involved in certifying these transactions.

The department has communicated a clear message to accountants and professionals involved in certifying foreign remittances, underscoring the need for proper care and thorough examination of the underlying transactions rather than relying solely on assertions made by entities. Such diligence is crucial for maintaining credibility within the tax system.

Investigations are continuing as the Income Tax Department employs increasing levels of data analysis and intelligence to identify transactions that misalign with the declared financial profiles of taxpayers.
