Delhi High Court Protects Allu Arjun’s Personality Rights with Interim Order

The Delhi High Court has released an interim order safeguarding the personality rights of Telugu actor Allu Arjun, explicitly prohibiting several entities from using his name, voice, and likeness for commercial purposes without his consent. The order, issued on April 17, responds to a lawsuit initiated by the prominent actor known for his role in the film Pushpa.

Justice Tushar Rao Gedela, in his observations, acknowledged Allu Arjun’s “stellar career” and noted that the actor’s well-known dialogues and distinct characteristics embody his “iconic status.” The court underscored the importance of protecting Arjun’s unique features, stating they are closely linked to his identity and he possesses exclusive rights to their commercial use.

The ruling indicated that failure to provide immediate relief could result in irreparable loss for the actor, emphasizing the significance of swift judicial intervention in such matters.

Details of the Restrictions Imposed

The court’s interim order restricts the defendants from utilising any of Allu Arjun’s attributes, which encompass his name, image, likeness, and any other distinctive features associated with him, without obtaining prior permission. This includes a broad range of technologies such as artificial intelligence, generative AI, machine learning, deepfakes, and face morphing utilized across both physical and digital platforms including websites, social media channels, and the metaverse.

Furthermore, the court directed various social media platforms to promptly remove specific content that infringes on Arjun’s rights. This action reflects the increasing necessity for legal frameworks to address emerging technologies that could potentially exploit personality rights without proper authorisation.

In this case, senior counsel Swathi Sukumar argued that Arjun’s persona was being exploited through various merchandise featuring his image and signature, voice-cloning technologies, AI chatbots, and even inappropriate content, which highlights the pervasive nature of this issue in today’s digital landscape.
