Brazil’s government has initiated legal proceedings against Discord, seeking Rs 500 million, which is approximately $97 million, in damages. This action is primarily based on the platform’s alleged inability to adequately protect minors online. Legal Allegations by the Brazilian Government

The unique 25-page lawsuit, shared with The Associated Press, identifies significant deficiencies in Discord’s age-verification protocols and protections for user safety. According to the Solicitor-General’s office, Discord is accused of violating numerous obligations set out in Brazilian law intended to safeguard vulnerable groups, particularly children and teenagers. The government is pursuing damages on the grounds of alleged collective psychological harm resulting from Discord’s practices.

In addition to the financial compensation, the Solicitor-General’s office has requested that the court compel Discord to enhance its parental control features immediately. The government has also called for greater collaboration with local law enforcement and the implementation of automated systems to monitor and eliminate harmful content on the platform. Earlier this month, officials further urged Discord to suspend live broadcasts linked to the incident that triggered the lawsuit.

Discord’s response to the lawsuit has described the government’s actions as “disproportionate,” asserting that the measures do not accurately represent the company’s commitment to safety nor its compliance with Brazilian regulations. The platform maintains that it prioritises user security and adheres to legal requirements regarding the protection of minors.

The lawsuit reflects broader legal pressures faced by Discord both in Brazil and internationally, with similar lawsuits reportedly underway in various U.S. states, including Texas, Nevada, and New Jersey. Brazilian President Luiz Inácio Lula da Silva is currently seeking re-election in October and has made the regulation of internet use by minors a priority, although the outcomes have been mixed thus far.

On August 6, Brazil’s first lady, Rosângela Lula da Silva, known as Janja, called for the platform to be taken offline, further highlighting the gravity of the situation surrounding the reported suicide. Furthermore, the Brazilian justice ministry has confirmed that five teenagers were arrested in connection with this tragic incident.

The lawsuit is indicative of a growing international movement to enforce stricter safety measures on social media platforms, especially concerning children.
