Delhi High Court Orders Jaideep Singh Senger to Surrender in Unnao Custodial Death Case

The Delhi High Court has directed Jaideep Singh Senger, also known as Atul Singh, to surrender by tomorrow. He is one of the convicts in the Unnao custodial death case, which also involves Kuldeep Singh Sengar and others. The recent directive comes as they seek a suspension of their ten-year sentence. The decision was made by a division bench comprising Justices Navin Chawla and Ravinder Dudeja during a hearing concerning an extension of interim medical bail previously granted to Senger. The bench denied the extension and noted that he had not surrendered.

Jaideep Singh Senger was initially granted interim bail in July 2024 for medical treatment related to cancer. Since then, the interim bail had been extended periodically until a plea for further extension could not be addressed. The bench insisted that Senger must first surrender before any further hearings can take place regarding his bail. Failure to comply with this order may result in coercive measures. The court has requested a status report on the plea and has scheduled the next hearing for February 24.

Legal Representation and Developments in the Case

Senger’s counsel informed the court that he intends to comply with the surrender order by tomorrow. The Delhi High Court had previously issued notices to all convicts in the Unnao custodial death case, including Kuldeep Singh Sengar, as well as the Central Bureau of Investigation (CBI). The victim in the infamous Unnao rape case has submitted an application requesting an increase in the sentences of the convicts, including Sengar, in relation to her father’s custodial death.

Currently, Jaideep Singh Senger is serving a ten-year term related to the custodial death case, while all other convicts, except for Kuldeep Singh Sengar, are on bail. The legal representative for the Unnao rape victim, Advocate Mehmood Pracha, has been actively pursuing this plea. Meanwhile, Advocate Anubha Bhardwaj, representing the CBI, stressed that the petition should only be discussed after evaluating its maintainability.

Previous Court Decisions and Future Proceedings

Earlier this week, a division bench of Justices Prathiba M Singh and Manju Jain had referred the case to the Chief Justice’s bench while addressing the victim’s daughter’s plea for prioritization of hearings. Kuldeep Singh Sengar is currently serving a ten-year sentence in the custodial death case and a life sentence for the rape of a minor. His appeals for both cases remain under consideration by the Delhi High Court.

The court had previously suspended Kuldeep Singh Sengar’s sentence in the custodial death case in December 2025; however, this order was subsequently stayed by the Supreme Court. The division bench noted that, following directives from the Supreme Court, the matter requires expedited decision-making within a three-month period. However, various aspects of the case are pending before different benches, complicating the timeline.
