Mumbai POCSO Court Grants Temporary Bail to Rape Accused for NEET-UG Re-Test

A special court in Mumbai has granted a temporary bail of four days to an 18-year-old individual who is facing rape charges. This bail is specifically to allow him to participate in the NEET-UG re-test scheduled for June 21. The court has set the bail period from June 18 to June 21, necessitating the accused to surrender to the authorities by 2 pm on June 22.

The accused is currently detained in Taloja Central Prison in Navi Mumbai. His temporary release was conditionally approved after the survivor expressed that she had no objections, provided there were assurances against any potential defamation or threats towards her family during this period.

The court required the accused to secure his release on a bond of Rs 50,000, accompanied by a surety of the same amount, ensuring compliance with the court’s conditions.

Legal Arguments Presented

Advocate Kapil Vishwas Zodge, representing the accused, emphasised the importance of rehabilitation within the criminal justice system. He argued that the young man should be afforded the opportunity to sit for this crucial medical entrance examination. Zodge further noted that the circumstances surrounding the exam could have an adverse effect on the accused’s mental well-being if conducted under police escort.

In contrast, Special Public Prosecutor Chaitrali Panshikar opposed this appeal due to the grave nature of the accusations. The prosecution argued that the accused should only be permitted to attend the examination under police escort for a single day, highlighting the potential risks associated with the accusations.

After thorough consideration of the high school examination certificate and the provisional NEET admit card produced by the defence, Special Judge SR Sharma remarked that there were “perspicuous valid grounds” warranting the provision of temporary bail. Addressing concerns raised by the prosecution, the judge stated that these apprehensions could be adequately managed through necessary conditions imposed on the release.

Conditions Imposed by the Court

While granting the temporary relief, the court mandated specific conditions aimed at ensuring the victim’s safety and the integrity of the case. The accused is prohibited from any form of contact with the victim during the bail period. Additionally, he must refrain from tampering with evidence or making any threats or inducements to any individuals connected with the case.

The judge required the accused to submit a formal undertaking, confirming his intention to appear for the examination. He must also provide evidence of his participation in the exam upon surrendering to the authorities as stipulated.

This court decision underscores the court’s balancing act between upholding the legal rights of the accused while ensuring the protections afforded to the victim within serious criminal proceedings. The court’s approach reflects a consideration of both the educational needs of the individual involved and the gravity of the allegations against him.
