Senator Alex Padilla, representing California, has renewed efforts on legislation aimed at providing a pathway to legal permanent residency for millions of long-term residents in the United States, including holders of H-1B visas. This initiative, formally titled the “Renewing Immigration Provisions of the Immigration Act of 1929,” was first introduced last year and has now been reasserted by Padilla as of Monday.

The senator characterised the Bill as a pragmatic solution designed to address what he terms as an outdated immigration framework. He pointed out that the proposal seeks to respond to systemic issues affecting migrants during the Trump administration, indicating that it serves as a corrective measure against previous policies that he believes mistreated immigrants.

Details of the Proposed Legislation

This legislative proposal, if passed, would enable individuals who have continuously resided in the United States for at least seven years to apply for permanent residency. According to information from Padilla’s office, it is estimated that over eight million individuals could benefit from this legislation. This group includes Dreamers, Temporary Protected Status recipients, children of long-term visa holders, essential workers, and highly skilled professionals, particularly those in the H-1B category who have faced protracted waits for their green cards.

Central to the Bill is an amendment to Section 249 of the Immigration and Nationality Act, known as the Registry provision. This provision allows the Secretary of Homeland Security to confer lawful permanent resident status on certain individuals who meet specific criteria, including a required presence in the country since a designated date. The existing fixed eligibility date is January 1, 1972, which Padilla’s Bill aims to replace with a rolling eligibility standard, thereby simplifying future adjustments.

Data from Padilla’s office shows that only 305 individuals successfully adjusted their immigration status under the current Registry provision from 2015 to 2019, illustrating the ineffectiveness of the outdated eligibility cut-off. The intent is for the new measure to facilitate easier access to permanent residency for long-term residents.

The Bill has garnered bipartisan support, co-led by Senate Democratic Whip Dick Durbin and includes sponsorship from several other prominent senators such as Cory Booker, Tammy Duckworth, and Elizabeth Warren. It has received endorsements from over 30 organisations advocating for immigrant rights and reform.

The employment-based immigration system in the US has been plagued by significant green card backlogs for years, particularly affecting Indian H-1B professionals due to per-country visa limits. Tens of thousands of skilled Indian workers, predominantly in technology and science, seek permanent residency annually, leading to extensive waiting periods. Reports indicate that Indian applicants comprise approximately 80 per cent of the backlog, with estimated waiting times ranging from 15 years to several decades.
