New IT Rules Mandate Clear AI Labels And Three-Hour Removal For Flagged Digital Content

The Indian government has notified stringent amendments to the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 to bring artificial intelligence generated and synthetic content under a firmer regulatory framework. The changes, issued by the Ministry of Electronics and Information Technology and set to take effect from February 20, 2026, sharply reduce the timeframe for social media and online platforms to respond to official takedown orders from 36 hours to just three hours. This move aims to address the rapid spread of potentially misleading, harmful or unlawful AI content online.

The updated rules formally define synthetically generated information, including deepfakes and other audio, visual or audio-visual content created or modified to appear real. Platforms such as Facebook, Instagram, YouTube and X are now obligated to act much more quickly when authorities flag content that violates the law, a change that reflects growing concerns about the misuse of AI tools on digital platforms.

Clear Labels And Metadata To Improve Transparency

Under the amended rules, intermediaries must also ensure that all AI generated content is clearly and prominently labelled so that users can identify it as synthetic or artificially produced. In addition to visible disclosures, the guidelines require platforms to embed permanent metadata identifiers where feasible, to help track the origin of such content and enhance traceability. Once an AI label or metadata tag is applied, platforms are not permitted to allow its removal or suppression.

The changes mark the first time that “synthetically generated information” has been explicitly brought within the scope of India’s intermediary regulations, treating it on par with other forms of information governed by the IT rules. This includes audio, video and image alterations that can misrepresent individuals, events or other real-world elements in ways that are likely to mislead the public.

Faster Grievance Redressal And User Accountability

Beyond the three-hour takedown window for unlawful content flagged by competent authorities or courts, the amendments specify that platforms must notify users at least once every three months about the consequences of violating platform policies and legal obligations, particularly those related to AI content misuse. They are also expected to deploy automated tools to detect and prevent the spread of illegal, deceptive or sexually exploitative AI content.

The revised framework comes at a time when generative AI tools are becoming more widespread and accessible, raising concerns about deepfakes, impersonation, content manipulation and other forms of online deception. Legal commentators and digital rights advocates have noted that the compressed compliance window may pose practical challenges for platforms while also raising questions about potential impacts on free speech and content moderation practices.

The government’s move is intended to protect users from the harms associated with fast-spreading misleading or harmful synthetic content, including deepfakes and impersonations. Users are now expected to exercise greater caution when creating or sharing content involving AI tools, as platforms will be required to enforce stricter labelling and removal protocols under the amended rules.

The government’s notification underscores India’s increasingly assertive stance on digital content governance and its efforts to balance innovation with accountability. The new regulations are part of a broader global trend towards tighter oversight of AI generated media, reflecting both opportunities and risks inherent in rapidly evolving technologies.
