However, this option comes with a stipulation requiring the payment of fifty per cent of the total challan amount before any legal proceedings can proceed.

Payment Requirement Before Court Hearing

The amount a vehicle owner must deposit depends on the value of the challan issued. For instance, if an e-challan is valued at Rs 2,000, the owner would need to pay Rs 1,000 as a prerequisite to initiate court proceedings. This system does not imply acceptance of the challan’s legitimacy; instead, it is a procedural requirement that must be fulfilled to advance the dispute in a judicial setting.

In the case where the court finds in favour of the vehicle owner, the amount paid as a deposit will be refunded. Continuing with the previous example, if the court agrees that the Rs 2,000 challan was incorrect, the Rs 1,000 deposit made will be returned to the driver. Conversely, if the court rules against the owner, they will be liable to pay the remaining half of the challan amount, effectively treating the payment as complete.

This revision of the traffic challan process reflects a significant shift in how disputes are managed and aims to encourage adherence to the regulations. It is expected to reduce frivolous court cases by ensuring that initial grievances are addressed effectively at the authority level.
