Victim’s Mother Moves Delhi High Court Seeking CBI Probe in Road Accident Case

The mother of Sahil Dhaneshra, who died in a road accident in Dwarka, has filed a petition with the Delhi High Court seeking a Central Bureau of Investigation (CBI) probe into the incident. Her son tragically lost his life on February 3, 2026, after he was reportedly struck and dragged by a vehicle driven by a minor, who was accompanied by his elder sister at the time. The petition alleges negligence on the part of the Investigation Officer handling the case.

The application, which will be heard by Justice Saurabh Banerjee, urges for the case to be transferred from the Delhi police to an independent investigative agency. Alternatively, the petitioner is requesting the court to ensure the Delhi police carry out a thorough and impartial investigation, possibly under the court’s supervision, within a specified timeframe.

Represented by advocates Aman Singh Bakshi, Shreesh Chaddha, and Divjot Singh Bhatia, the petitioner presents a case that demands accountability in what she describes as an inadequate investigation thus far.

Details of the Accident and Allegations of Negligence

The incident occurred due to the alleged reckless driving of a seventeen-year-old minor, who was reportedly at the wheel of the car involved. The petitioner claims that this tragic event not only claimed her son’s life but also resulted in severe injuries to another individual, a cab driver, who was affected by the incident. The petition paints a picture of a broader impact that goes beyond the family of the deceased, indicating that the circumstances of the accident raised serious concerns regarding road safety.

There is a growing apprehension that the investigation is being conducted in a rushed manner, with indications that it may be influenced by the accused and their associates. The petitioner argues that this has led to insufficient action against the parties directly involved in the accident. As of now, neither the father of the accused nor the other passenger in the vehicle has faced any charges or legal repercussions.

The lack of progress in the investigation is underscored by the allegation that critical evidence provided by the petitioner remains unverified by the Investigation Officer. This has deepened the petitioner’s concerns about transparency and fairness in the legal proceedings surrounding the case.

Concerns Regarding Juvenile Justice Board’s Orders

In addition to calling for a broader investigation, the petitioner has expressed dissatisfaction with the decisions made by the Juvenile Justice Board (JJB). She points out that the board’s orders appear contradictory, particularly concerning the accused’s perceived understanding of the gravity of his actions. During a hearing on February 4, the board reportedly noted that the minor showed no remorse for the incident.

Despite this assessment, the accused was granted interim bail on February 10 without prior notice to the petitioner. Subsequently, on March 10, he was released on regular bail under the custody of his father, an action that the petitioner believes contradicts earlier findings of the JJB.

The petitioner has articulated a genuine fear that the accused’s family is leveraging their influence to manipulate the investigation process, further motivating her to seek the High Court’s intervention for a more equitable examination of the facts surrounding this tragic accident.
