Uttar Pradesh Introduces New Labour Laws to Empower Workers and Boost Business

In a major reform aimed at improving workers’ rights and facilitating business growth, Uttar Pradesh has rolled out new labour laws that guarantee minimum wages, social security benefits, and enhanced protections for workers.

The state government has replaced 29 outdated labour laws with four comprehensive and modern codes, marking a historic shift in how labour rights and business operations are structured in the state.

Key Provisions of the New Labour Laws

The new labour codes aim to modernize the workforce in Uttar Pradesh by addressing the needs of contemporary workers, including those in gig, platform, and migrant sectors. These workers, previously excluded from many legal protections, will now benefit from social security coverage and other worker rights.

The key provisions of the new law include:

Minimum Wages for All Workers: Every worker in the state, irrespective of their sector, will be entitled to a minimum wage.

Social Security and Health Benefits: Workers in hazardous sectors like mining, chemicals, and construction will receive 100% health insurance. In addition, employees over the age of 40 will be entitled to annual health check-ups.

Equal Pay and Appointment Letters: The new laws guarantee equal pay for equal work and mandate that employers issue appointment letters to every worker, ensuring transparency and security.

Overtime Pay and Gratuity: Workers will receive double pay for overtime, and gratuity will now be available after just one year of continuous service, a major benefit for private-sector workers.

Women Workers Granted Right to Night Shifts

One of the most progressive aspects of the new labour laws is the right for women workers to take on night shifts. Women will now have the option to work night shifts, provided they give their consent and the necessary safety measures are in place.

This reform aims to improve gender equality in the workforce by providing women with the same opportunities and protections as their male counterparts.

Recognition of Gig and Platform Workers

The new labour laws provide formal recognition to gig and platform workers, including app-based drivers and delivery workers, such as those working for Ola, Uber, Zomato, and Swiggy.

For the first time, these workers will be entitled to social security benefits, including health coverage and retirement benefits. Aggregators will be required to contribute a percentage of their turnover to support these workers’ social security funds.

Streamlined Business Compliance

To encourage a more business-friendly environment, the state government has introduced a simplified compliance framework. Employers will now be required to adhere to a single-license and single-return system, reducing bureaucratic red tape and making it easier for businesses to operate in Uttar Pradesh.

With these new labour laws, Uttar Pradesh is positioning itself as a leader in labour rights and business growth. The reforms are aligned with the state’s vision of becoming self-reliant by 2047, ensuring that both workers and businesses can thrive in a modern, transparent, and equitable environment.
