In the Renukaswamy murder case, Kannada actor Darshan was granted bail by the Karnataka High Court, but it was cancelled by the Supreme Court on Thursday. The top court called the HC’s order “perverse” and “wholly unwarranted.”
The bench headed by Justice JB Pardiwala and Justice R Mahadevan termed the HC’s decision a “serious legal infirmity” and an “arbitrary exercise” of discretion. The judges noted that the Karnataka HC went into witness statements — a process meant for the trial court — before granting bail. The bench observed that there was no legal reason behind granting bail and warned that releasing the actor could “risk derailing the administration of justice.”
Quoting the famous line “no man is above the law,” Justice Pardiwala issued a strict warning that no special treatment should be given to the actor in jail.
“The day we come to know that the accused are being given five-star treatment in jail premises, we will place the jail superintendent under suspension,” Justice Pardiwala said, also instructing that the accused must not be allowed to smoke or drink in jail.
Ordering the actor’s immediate custody, the court stated, “In democracy, all persons are subject to equal access to law,” and noted, “We are satisfied to exercise our extraordinary jurisdiction.”
Following the order, prime accused Pavithra Gowda was also arrested from her residence in RR Nagar. Another accused, Pradosh, was arrested alongside her. Both are undergoing medical examination before being produced in the sessions court.
