Hansika Motwani Files Defamation Suit Against Sister-in-Law Over Domestic Violence Claims

Bollywood actress Hansika Motwani has initiated legal proceedings in a Mumbai sessions court, seeking compensation of Rs 2 crore for alleged defamation. The suit is directed against her estranged sister-in-law, Muskan Nancy James, who has accused both Motwani and her brother, Prashant Motwani, of domestic violence. In addition to the monetary damages, the suit requests a court injunction to prevent James from making further derogatory statements and calls for a public apology.

Represented by advocate Adnan Shaikh, Motwani’s petition contends that James has made unfounded and damaging allegations on social media platforms to avoid repaying a purported loan of Rs 27 lakh. According to the petition, this loan was taken during James’ marriage to Prashant Motwani, but she failed to repay it despite multiple reminders.

Motwani has asserted that her interactions with her brother’s marriage were limited and that she did not cohabit with the couple. She maintains that the relationship between Prashant and James has deteriorated over time and that she was largely unaware of the specifics of their marital disputes. The suit describes James as a “small-time television actor” who allegedly portrays a lavish lifestyle online while neglecting her financial obligations.

Allegations of Domestic Violence

This legal conflict arises from an earlier complaint lodged by James against her husband and Hansika Motwani, in which she accused them of cruelty and harassment. The First Information Report (FIR) included claims of domestic violence, interference in her marriage, and demands for expensive gifts during their wedding ceremonies. James also stated that the stress associated with her marriage led to her developing Bell’s Palsy, a condition characterised by facial paralysis.

Motwani has categorically denied all allegations cited in the FIR, asserting that she was not involved in any domestic arrangements with the couple and therefore cannot be held accountable for the claims made. Prior to this defamation suit, she had approached the Bombay High Court, requesting the quashing of the FIR on grounds that the allegations were baseless and aimed at harming her reputation. The High Court has acknowledged her plea by issuing a notice.

In addition to the civil defamation case, Motwani has also filed a criminal defamation case against James in a magistrate court in Andheri. This is in accordance with applicable sections of the Bharatiya Nyaya Sanhita, indicating that the dispute extends beyond civil matters and carries potential criminal implications.

Background of the Family Dispute

The contention stems from the troubled marriage between Prashant Motwani and Muskan Nancy James, who tied the knot in 2020 and have reportedly been living separately since 2022. Motwani has disclosed that discussions regarding divorce had already taken place and that she has been residing separately from her husband following her own marriage in 2022.

The forthcoming civil defamation suit is expected to be heard by the Dindoshi sessions court in due course. The resolution of this case may depend on the court’s determination regarding the validity of the claims made by both parties.

As this legal battle progresses, it remains to be seen how the allegations and counter-allegations will unfold in the legal arena. The implications of the case extend beyond personal grievances, as they touch upon broader issues of reputation and accountability within public and family life.
