Supreme Court Requests Centre to Explore Alternate Venue for Delhi Protests

The Supreme Court has asked the Indian government to consider finding a different location for peaceful protests other than Jantar Mantar in New Delhi. This request was made during a session on October 6, 2023, where the court highlighted the necessity for a space equipped with basic facilities for demonstrators. Chief Justice Surya Kant, presiding over the bench, stressed the importance of accommodating peaceful gatherings in a suitable environment.

Context of the Case

This discussion transpired amid a plea against stringent restrictions being proposed for metro stations and the cancellation of train services entering Delhi ahead of a planned demonstration. The protest is organised by the Cockroach Janta Party (CJP) in collaboration with several student groups, who are objecting to the actions of Chief Election Commissioner Gyanesh Kumar.

Solicitor General Tushar Mehta represented the government during the hearing, indicating that the relevant authorities would consider allocating an appropriate site for future protests. Senior advocate Kapil Sibal expressed agreement with the suggestion for a new venue, underscoring the collaborative nature of the discussions during the hearing. The related bench included justices Joymalya Bagchi and V Mohana, who echoed the sentiments expressed regarding the urgent need for a protest site that meets the basic requirements for lawful assemblies.

During proceedings, the court was informed that police authorities had prohibited the CJP and the Indian Youth Congress from assembling at Jantar Mantar, which is traditionally viewed as the designated protest area. The possibility of using Ramlila Maidan, another potential protest location, was reportedly not taken into account, as per the submissions made by advocate Prashant Bhushan, who argued that demonstrators should have been permitted to gather there.

Concerns Raised by the Court

Chief Justice Surya Kant raised practical concerns regarding the logistics of protests at Jantar Mantar, particularly due to its proximity to government residences and the homes of certain Members of Parliament. He pointed out the numerous challenges protesters face in that vicinity, noting the absence of basic amenities like toilets, which further complicates the situation for those gathering to express their grievances.

Solicitor General Mehta also highlighted potential emergency issues, mentioning that ambulances may struggle to reach the site should a protester require medical attention. Such considerations reinforce the court’s position that a designated site for lawful protesting ought to have adequate facilities to ensure the safety and comfort of individuals participating in demonstrations.

After summarising their concurrence on the necessity of an alternative venue, the bench delegated the responsibility of evaluating the proposal to the competent authority. The Supreme Court has thus handed over the task of identifying a suitable protest location while emphasising the importance of ensuring that basic facilities are available to demonstrators.

In light of the court proceedings, Solicitor General Mehta reiterated the government’s commitment to considering the establishment of an alternative protest venue.
