Supreme Court Criticizes Gurugram Police for Handling of Rape Case Involving 4-Year-Old

The Supreme Court expressed strong discontent with the Gurugram Police regarding their investigation of a rape case involving a four-year-old girl. The court emphasized that the survivor has been left deeply traumatized due to what it termed a “careless and insensitive” approach by the police. The Chief Justice of India, Surya Kant, remarked that the officers appeared to be “completely unaware” of the legal obligations set forth under the Protection of Children from Sexual Offences (Pocso) Act.

Police and Child Welfare Authorities Under Scrutiny

The bench criticized the actions of both the police and child welfare authorities, stating that their conduct has significantly intensified the distress experienced by the child. The court pointed out serious deficiencies within the investigation process and noted attempts to minimize the severity of the offense. These comments from the bench reflect a growing concern regarding the safeguarding of vulnerable individuals in such cases.

Formation of a Special Investigation Team

In response to these shortcomings, the Supreme Court has ordered the establishment of a Special Investigation Team (SIT) to oversee the case. This team will be led by a female Indian Police Service (IPS) officer. Furthermore, the bench directed that all related records be submitted to facilitate a thorough investigation. The court’s actions signify a commitment to ensuring that justice is served and that such sensitive cases are handled appropriately.

Show-Cause Notices Issued

The Supreme Court also issued show-cause notices to the involved police officials as well as members of the Child Welfare Committee. This move is intended to hold those responsible accountable for their actions, especially given the gravity of the situation involving the young survivor. The court’s directives highlight the need for a more structured and sensitive approach in cases involving child victims of sexual offenses.
