Lok Sabha Passes Transgender Persons Amendment Bill 2026 Amid Protests

On March 24, the Lok Sabha passed the Transgender Persons (Protection of Rights) Amendment Bill 2026 through a voice vote. The legislation was introduced by Virendra Kumar, the Minister for Social Justice and Empowerment. This new bill revises the original law enacted in 2019, focusing on recognizing specific categories of transgender individuals who experience significant social challenges.

Revised Definition of Transgender Persons

The amendment specifically redefines what constitutes a transgender person, narrowing it to exclude certain individuals based on their identity. According to the bill, a transgender person is one who identifies as kinner, hijra, aravani, jogta, eunuch, or a person with intersex variations. The definition also considers congenital variations in sex characteristics that may diverge from typical male or female development, including primary sexual traits and chromosomal patterns.

Changes to Certification Procedures

Under the amended legislation, the District Magistrate is granted the authority to issue identity certificates after consulting with an appointed authority and, if necessary, medical experts. This represents a significant procedural change compared to previous practices specified in the original act.

Community Concerns and Protests

The amendment has sparked protests among transgender communities across India. Activists voiced concerns that the bill, instead of providing better rights and protection, could diminish their identities. Notably, the bill disallows individuals who “self-perceive” as transgender from recognition, which many in the community find troubling.

Political Reactions

Reacting to the bill, Congress Member of Parliament Priyanka Gandhi Vadra expressed her disappointment regarding its passage without prior review by a standing committee. She emphasized the need for proper consultation with the transgender community, stating that many members feel their identity is at risk of being undermined. According to her, the lack of engagement in the legislative process represents a significant oversight by the government.

Next Steps for Lok Sabha

Following the passage of the bill, the Lok Sabha has adjourned until 11 am on Wednesday, giving time for additional discussions and considerations. The initial introduction of the bill on March 14 triggered widespread protests, indicating the levels of concern surrounding its implications for the transgender community in India.
