India has formally rejected observations made by the United Nations Committee on the Elimination of Racial Discrimination (CERD), describing them as “politically motivated” and “highly malicious.”

The response was issued by the Ministry of External Affairs (MEA) after CERD released its observations following India’s 11th periodic review under the International Convention on the Elimination of All Forms of Racial Discrimination (ICERD).

Review Held in Geneva

India’s review was conducted in Geneva on August 11 and 12. The MEA described the process as a routine treaty-body exercise and said India participated with a commitment to constructive engagement.

The ministry reaffirmed the country’s commitment to combating racial discrimination and highlighted constitutional safeguards, its legal framework, and measures aimed at protecting disadvantaged communities.

Indian Delegation Rejects Allegations

The Indian delegation, led by Solicitor General Tushar Mehta, rejected what it described as sweeping generalizations and unsubstantiated allegations made by the committee.

The MEA strongly criticized references in the report that it considered politically motivated and malicious.

UN Committee Raises Concerns

CERD raised concerns over alleged “large-scale violations” by law enforcement agencies against ethnic minorities, Indigenous and Tribal Peoples, including Scheduled Tribes and Scheduled Castes, particularly Dalits, as well as non-citizens.

The observations formed part of the committee’s assessment of India’s implementation of its obligations under ICERD.

What Is CERD?

The Committee on the Elimination of Racial Discrimination is an independent panel of experts responsible for monitoring how countries implement the ICERD.

The latest review examined India’s combined periodic reports covering its obligations under the convention. India submitted the relevant reports in 2023.

India Highlights Constitutional Safeguards

During the review, the Indian delegation emphasized the country’s pluralism, diversity, constitutional framework, and affirmative-action policies.

It also highlighted socio-economic initiatives intended to promote equality and dignity for disadvantaged communities.

India’s Continued Engagement With Human Rights Frameworks

The MEA emphasized India’s longstanding engagement with international human rights mechanisms. It also pointed to the country’s historical role in the negotiation and drafting of the ICERD during the 1960s.

The exchange underscores the continuing engagement between India and international human rights bodies over the implementation of global commitments to combat discrimination.
