Barricades Removed at Jantar Mantar, Easing Movement for Local Residents

The CSR Journal Magazine

The recent removal of barricades around Jantar Mantar has facilitated easier movement for local residents. This action occurred shortly after the site was denotified as an authorised protest venue, following recommendations from a committee established by the Ministry of Home Affairs. Residents had expressed their concerns regarding the prolonged restrictions, which they claimed were causing significant inconvenience and impacting their daily activities.

Some residents took legal action against the Delhi Police, arguing that the barricading was excessive and detrimental to their quality of life. The restrictions gained heightened attention during recent protests, particularly those involving the Cockroach Janta Party and student groups, which led to a fortified security presence around Lutyens’ Delhi to prevent access to the protest area.

In response to the protests, Delhi Police implemented extensive security measures, including barricades at various entry points, movement restrictions, and a heavy deployment of personnel. These actions aimed to deter any unauthorised gatherings or marches towards Jantar Mantar, invoking Section 163 of the BNSS to restrict mass gatherings due to law and order concerns.

Official Denotification and Relocation of Protests

On October 11, the Delhi Police Commissioner issued a standing order that officially denotified Jantar Mantar as a designated protest site. In light of this decision, the police relocated authorised demonstrations to three alternative venues: Ramlila Maidan in central Delhi, CBD Ground in east Delhi, and Burari Ground in north-west Delhi. This shift has been positioned as a necessary measure to enhance public safety and manage traffic congestion.

During proceedings in the Supreme Court, Delhi Police asserted that Jantar Mantar is no longer suitable for protests. They emphasised that a public road should not serve as a permanent protest site, citing concerns related to public safety, traffic flow, emergency access, and the security of critical installations in the vicinity.

In a counter affidavit submitted to Chief Justice of India Surya Kant, Delhi Police Commissioner Anurag Kumar outlined that the decision to denotify Jantar Mantar was made after thorough consideration of the committee’s recommendations. The committee unanimously concluded that the site was inappropriate for protests and demonstrations.

Historical Significance of Jantar Mantar

Historically, Jantar Mantar has been a prominent location for political demonstrations, public agitations, and civil society protests in India. Over the years, the site has hosted numerous high-profile movements that have attracted national attention and shaped the country’s political discourse. Political parties, activists, and social organisations have frequently chosen this location to voice their demands and concerns.

Located in the heart of the national capital, Jantar Mantar has served as a focal point for various groups seeking to engage with the government on pressing issues. The recent denotification marks a significant shift in the use of this site, which had long been regarded as a vital platform for public expression.

The affidavit submitted by the Delhi Police highlighted the proximity of 78 foreign embassies, diplomatic missions, and offices of international organisations within a 3-4 km radius of Jantar Mantar. This factor was cited as a key reason for the decision to relocate protests, underscoring the need for security and order in the area.
