Assam Govt tables Polygamy Prohibition Bill in Assembly

Assam Chief Minister Himanta Biswa Sarma on Tuesday tabled the Assam Prohibition of Polygamy Bill, 2025 in the state Assembly, marking a significant move toward banning the practice across the state. The bill was presented after Speaker Biswajit Daimary granted approval.

However, the tabling took place in the absence of Congress, CPI(M), and Raijor Dal legislators, who had walked out earlier during a discussion on the death of noted singer Zubeen Garg.

What the Bill seeks to do

Polygamy — defined as having more than one living spouse at the same time — continues to be practiced within certain communities in Assam.

The proposed legislation aims to prohibit polygamy across the state, regardless of religious or customary laws and establish that personal laws cannot override the dignity and rights of women.

The bill was introduced on the first day of the Winter Session and will be taken up for detailed discussion and possible passage at a later date.

Chief Minister Sarma has repeatedly clarified the government’s strong stance on the issue.

He stated that entering into another marriage without a legal divorce from the existing spouse would attract a minimum of seven years’ imprisonment and penalties applicable irrespective of religious background

“Religious justification won’t do,” Sarma had said earlier, adding that the government was committed to eliminating the practice entirely.

Part of broader legal reforms

The bill aligns with the Assam government’s ongoing push toward broader civil reforms.

In recent years, the state has closed state-run madrassas and engaged in legislative discussions surrounding marriage and family practices.

The anti-polygamy bill is seen as another step in the BJP-led government’s efforts to establish a more uniform legal framework, particularly concerning marriage laws.
