Delhi Court Sentences Congress MLA Rajendra Bharti to 3 Years in Bank Fraud Case

The Rouse Avenue Court in New Delhi has sentenced Rajendra Bharti, a current Congress MLA representing the Datia Assembly constituency in Madhya Pradesh, and co-defendant Raghubir Sharan Prajapati to three years imprisonment. This ruling stems from their involvement in a fraud case linked to the Gramin Vikas Bank. Additionally, Bharti was ordered to pay a fine of Rs 1 lakh, while Prajapati’s fine amounts to Rs 2.5 lakh. The verdict was pronounced by Special Judge Dig Vinay Singh, who found both men guilty of criminal conspiracy, forgery, and cheating.

The court’s decision cited multiple sections of the Indian Penal Code (IPC), including Section 120B for criminal conspiracy, along with Sections 420, 467, 468, and 471 concerning fraud and forgery. Both Bharti and Prajapati were accused in the case involving alleged misuse of funds from a fixed deposit originally made by Bharti’s mother, Savitri Shyam, who passed away during the trial.

In detail, Prajapati received multiple sentences under various sections of the IPC, including three years for criminal conspiracy, and specific fines for works involving forgery and cheating. These allegations arose from an investigation initiated by the Zila Sahkari Krishi Aur Gramin Vikas Bank, which filed a complaint against Bharti and his mother in July 2015.

The legal journey began with a complaint filed on July 29, 2015, concerning a fixed deposit made on August 24, 1998, by Savitri Shyam. The deposited amount was Rs 10 lakh, intended for a trust named Shri Shyam Sunder Shyam Jan Sahyog Evam Samajik Vikas Sansthan, located in Mundian Ka Kuan, Datia, Madhya Pradesh. This deposit was made for a three-year period with an interest rate of 13.5 per cent per annum. Instead of receiving the maturity amount at the agreed time, Savitri allegedly withdrew annual interest payments of Rs 1.35 lakh over a span of twelve years, violating the terms of the fixed deposit.

The allegations relay significant implications regarding the accountability of public representatives in financial transactions. Ajay Yadav, a spokesperson for the Bharatiya Janata Party (BJP), expressed approval of the court’s ruling, alleging that it showcases the Congress party’s systemic corruption. He called for self-reflection within the Congress, alleging a continued trend of electing “criminal elements” to public offices. His remarks reflect a broader narrative in Indian politics regarding accountability and ethics within political parties.

Conversely, Congress Media-in-charge Mukesh Nayak asserted that the timing of the court’s decision, now nearly twenty-five years after the initial complaint, is questionable. He suggested that the BJP is exploiting the judicial system to undermine opposition ahead of upcoming elections. Nayak accused the BJP of utilising state institutions to achieve political objectives, framing the case within a narrative of political rivalry.
