SC Issues Notice on Plea Challenging Immunity for Election Commissioners

The CSR Journal Magazine

The Supreme Court has issued a notice regarding a public interest litigation that contests the blanket immunity granted to the Chief Election Commissioner (CEC) and Election Commissioners under the Chief Election Commissioner and Other Election Commissioners Act, 2023. This legal action is aimed at questioning the constitutional validity of Section 16 of the Act.

It provides legal protection for the CEC and Election Commissioners concerning actions taken in their official capacities during their tenure. A bench comprising Chief Justice Surya Kant and Justices Joymalya Bagchi and V Mohana requested responses to the plea. The law, enacted by Parliament in 2023, has become a focal point of contention, especially amid recent protests led by the Cockroach Janta Party (CJP).

The provision in question shields the CEC and Election Commissioners from legal proceedings related to any statements, actions, or decisions made while in office, as long as the law is in effect. The petitioner, Arun Kumar Agrawal, who is both an activist and a lawyer, has argued that the immunity provided by this section is overly broad.

He contends that it offers protection without exceptions, even for actions that may not be executed in good faith or fall outside the officials’ jurisdiction. The plea asserts that such comprehensive immunity undermines citizens’ rights to civil and criminal remedies against the CEC and Election Commissioners.

Concerns Over SIR Process

The notice was issued while the Supreme Court was also addressing a separate set of petitions that challenge the Election Commission’s Special Intensive Revision (SIR) of electoral rolls. During the hearing, the bench expressed concerns regarding the SIR process, questioning whether it had been designed to intimidate or harass voters.

The court raised queries about the urgency of conducting this exercise in Delhi, especially when no elections were on the immediate horizon. The bench remarked that the Election Commission should not enforce rigid timelines and that the process for submitting enumeration forms late should remain accessible.

Additionally, it questioned the rationale behind requiring voters, whose names were absent from the draft rolls but were already registered, to fill out Form 6 again.  Justice Bagchi posed the critical question of whether a voter could be penalised for negligence by permanently stripping them of their voting rights.

The court directed the Election Commission to ensure that physical lists of deleted voters are displayed in local languages at the block level. It reassured petitioners and voters that there was no cause for alarm, as the matters were still under consideration. The Election Commission informed the court that it would contemplate extending deadlines in Delhi and accommodating late submissions of enumeration forms.

Future Proceedings and Voter Rights

The next hearing regarding the SIR matter has been scheduled for November 19. The court clarified that the deletion of a name due to the SIR or the expiration of a deadline does not permanently bar a voter from being added to the electoral roll. Citizens retain the right to seek corrections to the rolls until the final date for filing nominations.

This ongoing legal discourse highlights the complexities surrounding electoral processes and the balance between maintaining the integrity of the Election Commission and ensuring accountability to the public. The implications of the Supreme Court’s decisions in these matters could significantly influence the future of electoral governance in India.

As the Supreme Court continues to deliberate on these issues, the outcomes may have lasting effects on the relationship between the Election Commission and the electorate, particularly concerning the rights and responsibilities of voters in the democratic process.
