2026 Assembly Elections: Election Commission’s Counting Process Under Supreme Court Scrutiny

The Election Commission of India has established a well-defined framework for the personnel involved in the counting process of votes cast in Electronic Voting Machines (EVMs). This structure has even been subject to scrutiny by the Supreme Court. Each Assembly constituency appoints a Returning Officer who is responsible for overseeing the entire counting procedure.

At the counting table, a team consisting of four members is tasked with the meticulous process of tallying votes. This team comprises a counting supervisor, an additional supervisor, a micro observer, and a member from the Group D Multi-Tasking Staff (MTS). The supervisors play a crucial role in ensuring accuracy, with at least one needing to be a Central government employee.

The MTS personnel support the counting team by managing essential equipment and documentation, following the directives provided. Around the counting table, agents authorised by candidates can observe the proceedings, ensuring transparency in the process.

Roles and Qualifications of Counting Team Members

The counting supervisor is usually a gazetted officer or holds an equivalent rank, while the additional supervisor must meet criteria equivalent to a Group B officer. Both individuals are selected from a pool of polling personnel through a randomised process. They are assigned to specific counting tables and Assembly segments without prior notice to ensure fairness in the selection process.

To enforce security protocols, photo identity cards embedded with QR codes are issued to all counting personnel. These QR codes are verified through a three-tier security system that includes scanning devices and manual checks, enhancing the integrity of the counting process. This system ensures that only those authorised can access sensitive areas during the counting.

It is important to note that the micro observer is typically a Central government employee, and the Group D staff member supports the supervisors in various capacities. The selection of counting personnel must strictly adhere to the guidelines listed in Annexure-35, which delineate qualifications and roles for each position in the counting process.

Security Measures and Conduct During Counting

The Returning Officer plays a pivotal role in maintaining order during the counting process by enforcing strict regulations. For instance, no individual, except for authorised officials such as the Returning Officer or Observer, is permitted to bring mobile phones inside the counting centre up to the counting table. This measure seeks to mitigate any potential interference with the counting process.

Prior to the commencement of counting, officials must verify the identities of all team members using an app-based database and their identification cards, followed by written confirmation to ensure accuracy and accountability. This step is critical in preventing any discrepancies during the counting of votes.

During the actual counting, participants—including officials, staff, and authorised agents—are prohibited from leaving the counting premises unless in case of a medical emergency or urgent need for restroom facilities. This regulation aims to preserve the integrity of the counting process and minimise any external influences.
