संपत्ति खरीदने का अधिकार

यदि किसी का नाम वोटर लिस्ट से कट गया है, तो भी वह भूमि या संपत्ति खरीदने का अधिकार रखता है। यह अधिकार नागरिकता से जुड़ा है, जबकि वोटर लिस्ट से नहीं। जब तक गृह मंत्रालय किसी को गैर-नागरिक नहीं घोषित करता, तब तक लोग अपनी संपत्ति खरीद सकते हैं।

SIR प्रक्रिया के बाद कई नागरिकों ने यह शिकायत की है कि उनका पासपोर्ट नवीकरण नहीं हो रहा। लेकिन यह सच है कि पासपोर्ट केवल अन्य दस्तावेजों के आधार पर जारी होता है, न कि वोटर लिस्ट के आधार पर। अतः, नाम कटने से पासपोर्ट या विदेश यात्रा के अधिकार पर कोई रोक नहीं लगेगी।

सरकारी योजनाओं का अधिकार

नागरिकता से जुड़े होने के कारण, राशन और अन्य सरकारी योजनाओं का अधिकार भी सुनिश्चित रहता है। भले ही नाम SIR में कट गया हो, लेकिन लोग योजनाओं के लाभ के लिए योग्य रहेंगे। हालांकि, कुछ स्थानों पर इस संबंध में समस्याएं भी सामने आई हैं, जैसे पश्चिम बंगाल में राशन कार्ड का रद्द होना। सुप्रीम कोर्ट ने इस मामले में उचित कदम उठाने के निर्देश दिए हैं।

पश्चिम बंगाल में विशेष गहन पुनरीक्षण (Special Intensive Revision – SIR) विवाद पर सुनवाई करते हुए सुप्रीम कोर्ट ने स्पष्ट फैसला सुनाया है कि किसी व्यक्ति की नागरिकता तय करना चुनाव आयोग का संवैधानिक अधिकार नहीं है। न्यायमूर्ति सूर्यकांत और न्यायमूर्ति जॉयमाल्या बागची की पीठ ने साफ किया कि चुनाव आयोग (ECI) की भूमिका केवल मतदाता सूची के नियंत्रण और पर्यवेक्षण तक ही सीमित है।

पश्चिम बंगाल में SIR मुद्दे पर सुप्रीम कोर्ट की सुनवाई

पश्चिम बंगाल के SIR विवाद पर शुक्रवार को सुप्रीम कोर्ट ने अपनी स्थिति स्पष्ट की। अदालत ने कहा कि चुनाव आयोग को केवल मतदाता सूची के नियंत्रण और पर्यवेक्षण तक सीमित अधिकार है। इसके साथ ही, नागरिकता का निर्धारण आयोग का कार्य नहीं है। अदालत ने इस मामले में किसी भी भ्रम को दूर करते हुए कहा कि यदि कोई ट्रिब्यूनल किसी व्यक्ति का नाम SIR सूची से हटाता है, तो चुनाव आयोग को नागरिकता निर्धारण के लिए मामला संबंधित मंत्रालय को भेजना होगा।

मतदाता सूची से नाम हटाना नागरिकता का अंत नहीं

सुप्रीम कोर्ट ने कहा कि कोई व्यक्ति अगर मतदाता सूची में नाम नहीं होने के कारण समस्याओं का सामना करता है, तो इससे उसकी नागरिकता अपने आप समाप्त नहीं होती। इस मामले में अदालत का कहना है कि नागरिकता का निर्धारण मात्र चुनाव आयोग के अधिकार क्षेत्र में नहीं आता है।

नागरिकता पर प्रभाव नहीं

सुप्रीम कोर्ट ने आदेश दिया कि मतदाता सूची से नाम हटने का सीधा असर केवल मतदान के अधिकार पर पड़ता है। यदि चुनाव आयोग की विशेष अदालतों (Special Tribunals) द्वारा किसी व्यक्ति का नाम SIR सूची में शामिल नहीं किया जाता या नागरिकता पर संदेह होता है, तो आयोग को यह मामला नागरिकता निर्धारण के लिए केंद्रीय गृह मंत्रालय के सक्षम प्राधिकारी को भेजना होगा। अंतिम फैसला नागरिकता अधिनियम (Citizenship Act) के तहत वही प्राधिकारी करेगा।

सरकारी योजनाओं के लाभ पर रोक नहीं

शीर्ष अदालत ने उस याचिका पर भी विचार करने की सहमति दी है जिसमें आरोप लगाया गया था कि मतदाता सूची से नाम हटने के बाद लोगों को सार्वजनिक वितरण प्रणाली (PDS) और अन्नपूर्णा जैसी कल्याणकारी सरकारी योजनाओं के लाभ से वंचित किया जा रहा है। कोर्ट ने स्पष्ट किया कि कानूनी स्थिति स्पष्ट होने तक प्रभावित लोगों को लाभ से वंचित नहीं किया जाना चाहिए।

वर्तनी की गलतियों पर सवाल

सुनवाई के दौरान कोर्ट ने पुलिस और प्रशासन द्वारा केवल अंग्रेजी में नामों की अलग-अलग वर्तनी या रिकॉर्ड में मामूली त्रुटियों के आधार पर लोगों के पासपोर्ट रिन्यूअल रोकने या उन्हें संदिग्ध मानने पर भी गंभीर सवाल उठाए। अदालत ने ट्रिब्यूनलों के कामकाज में पारदर्शिता बढ़ाने की मांग पर भी संज्ञान लिया है और मामले की अगली सुनवाई 25 अगस्त 2026 को तय की है।

सुनवाई के दौरान जस्टिस बागची की टिप्पणी

सुनवाई में जस्टिस बागची ने कहा कि निर्वाचन आयोग का यह संवैधानिक दायित्व नहीं है कि वह नागरिकता तय करे। उनके अनुसार, आयोग का अधिकार केवल चुनावी प्रक्रिया को फैसले में शामिल करने तक सीमित है। इस पर वरिष्ठ वकील गोपाल शंकरनारायण ने कहा कि ट्रिब्यूनलों के संचालन में कई असंगतियां हैं, जो मामलों के निस्तारण में देरी का कारण बन रही हैं।

पिछली सुनवाई में कोर्ट का निर्देश

बुधवार की सुनवाई में सुप्रीम कोर्ट ने कहा कि पश्चिम बंगाल में SIR के बाद जिन लोगों के नाम वोटर लिस्ट से हटा दिए गए थे, वे अब भी कल्याणकारी योजनाओं के तहत लाभान्वित हो सकते हैं। वहीं, राशन कार्ड निलंबित करने के मामले में, अदालत ने याचिकाकर्ता को राहत देने से इनकार करते हुए उन्हें कलकत्ता हाई कोर्ट जाने का निर्देश दिया।

नई तारीखों का विवरण

बदले हुए शेड्यूल के अनुसार, दिल्ली में ड्राफ्ट वोटर लिस्ट अब 5 अगस्त के बजाय 17 अगस्त को प्रकाशित होगी। पंजाब में, घर-घर जाकर वेरिफिकेशन की डेडलाइन को 24 जुलाई से बढ़ाकर 3 अगस्त कर दिया गया है। वहीं, पंजाब की ड्राफ्ट वोटर लिस्ट 31 जुलाई के बजाय 13 अगस्त को प्रकाशित होगी। यहाँ तक कि फाइनल वोटर लिस्ट की जारी करने की तारीख को भी 10 अक्टूबर से 12 अक्टूबर कर दिया गया है।

तेलंगाना और कर्नाटक का नया शेड्यूल

तेलंगाना में ड्राफ्ट वोटर लिस्ट अब 10 अगस्त को प्रकाशित होगी, और फाइनल लिस्ट 12 अक्टूबर को जारी की जाएगी। इसी तरह, कर्नाटक में BLOs का घर-घर जाकर वेरिफिकेशन का काम अब 8 अगस्त तक चलेगा। कर्नाटक में ड्राफ्ट वोटर लिस्ट 17 अगस्त को प्रकाशित होगी, जबकि फाइनल वोटर लिस्ट 19 अक्टूबर को जारी की जाएगी। यह बदलाव राज्यों में चुनाव प्रक्रिया को सुगम बनाने के लिए किया गया है।

हरियाणा और आंध्र प्रदेश का भी शामिल

चुनाव आयोग ने इससे पहले हरियाणा और आंध्र प्रदेश के लिए भी SIR शेड्यूल को आगे बढ़ाया था। अब पूरे देश में लगभग सभी राज्यों और केंद्र शासित प्रदेशों में SIR की प्रक्रिया पूर्ण होने वाली है, केवल हिमाचल प्रदेश, जम्मू-कश्मीर और लद्दाख को छोड़कर। इस सभी राज्यों में स्पेशल इंटेंसिव रिविजन का यह बड़ा अभियान 14 मई को शुरू किया गया था।

आवश्यकता क्या है?

चुनाव आयोग का यह अभियान सुनिश्चित करने के लिए चलाया जा रहा है कि देश की वोटर लिस्ट सटीक और अपडेटेड हो। इस प्रक्रिया में अधिकारियों और संसाधनों के बीच तालमेल बिठाने की आवश्यकता के कारण कुछ तारीखों में बदलाव करना पड़ा है। जैसे-जैसे यह अभियान आगे बढ़ेगा, अधिक से अधिक लोग सही जानकारी का हिस्सा बन सकेंगे। यह सब कुछ चुनावी प्रक्रिया को और भी पारदर्शी बनाने के लिए किया जा रहा है।

To begin the verification process, voters should visit the official ECI voters’ services portal at voters.eci.gov.in.

On the homepage, select the “Fill Enumeration Form” option to access the relevant section of the portal.

First-time users will need to create an account before they can check the status of their Enumeration Form.

New Users Must Complete Registration Process

Voters accessing the portal for the first time should select the “Sign Up” option.

They will then need to enter their mobile number, an optional email address and the captcha displayed on the screen.

After providing the required details, users should complete the registration process to create their account on the ECI portal.

Existing Users Can Log In Using OTP

Voters who are already registered on the portal should select the “Login” option.

Users must enter their mobile number and captcha before clicking on “Request OTP”.

The OTP received on the registered mobile number must then be entered to complete the verification and login process.

Enter EPIC Number To Check Enumeration Form Status

After logging in, the voter’s name will appear at the top of the webpage.

Users should again select the “Fill Enumeration Form” option and enter their EPIC number, commonly known as the Voter ID number, in the designated field.

After entering the EPIC number, click the “Search” button to check the status of the Enumeration Form.

How To Know If BLO Has Uploaded Your Form

If the Enumeration Form has already been uploaded, the portal will display the message: “Your form has already been submitted with mobile number XXXXX.”

The confirmation message indicates that the voter’s Enumeration Form has been submitted and uploaded to the portal.

If no confirmation message appears and the portal instead opens a fresh Enumeration Form page, it generally indicates that the document has not yet been uploaded.

What To Do If Enumeration Form Details Are Incorrect

Voters should carefully check the information displayed on the portal after searching for their Enumeration Form.

If an unfamiliar mobile number is shown or the portal indicates that the form has already been submitted even though the voter did not submit it, the voter should contact their BLO without delay.

The Booth Level Officer can verify the information and facilitate corrections if discrepancies are found in the Enumeration Form submission details.

The SIR exercise aims to ensure that every eligible voter receives two copies of the enumeration form. This distribution will continue until July 29, before transitioning to a phase focused on bolstering the submission and digitisation processes. Efforts are concentrated on reaching every voter in the capital to update their records.

According to the statement from the Delhi Chief Electoral Officer’s office, special camps are currently being established across the city. These camps provide assistance for voters to fill out the forms and submit them through booth-level officers (BLOs). Voters also have the option to complete the forms online. Notably, no documentation is required when submitting these forms.

District-wise Distribution and Digitisation Progress

Among the various districts, North East Delhi has recorded the highest number of forms issued, totalling 10,01,304. Following this, West Delhi accounted for 8,57,123 forms distributed, East Delhi had 8,04,233, South Delhi noted 7,28,647, and South East registered 6,63,425 forms. In percentage coverage, New Delhi district led with 67.20 per cent of voters receiving forms, while Old Delhi followed closely at 61.69 per cent.

Further analysis shows that North reported 59.20 per cent coverage, and West achieved 58.87 per cent. Conversely, South East had the lowest at 42.60 per cent, with South West at 45.45 per cent, Central at 47.35 per cent, and Outer North at 49.40 per cent. Digitisation of the completed forms has seen varied success, with South West leading in total completed forms at 45,186, followed by Outer North at 38,937.

Outer North reported the best digitisation rate, achieving 4.68 per cent, with South West at 3.40 per cent. Other districts such as Central North and West followed with 2.55 per cent and 2.38 per cent, respectively. Comparatively, East had the lowest rate at 1.05 per cent, alongside Central and North East at 1.03 per cent each, while both Old Delhi and North East recorded 1.10 per cent.

Implications for Final Voter Roll

The Chief Electoral Officer’s office has emphasised the importance of filling out the enumeration form for voters who wish to be included in the final electoral roll. The final roll is scheduled for publication on October 7. Those who fail to submit the forms will have their names removed from the draft roll, which is expected to be published on August 5.

Overall, officials outlined that the focus during the first week of the SIR initiative has been on extensive form distribution. The upcoming weeks will see an intensified approach towards the submission and digitisation of these forms, ensuring a comprehensive voter registration process in the capital.

बिहार में 65 लाख नामों की कटौती

बिहार में पहले चरण में 65 लाख लोगों का नाम वोटर लिस्ट से हटा दिया गया। इसके बाद से सामाजिक कार्यकर्ता और विपक्षी पार्टियां आरोप लगा रही हैं कि कई लोगों को जरूरी दस्तावेजों की कमी के कारण वोट देने से रोका गया है। जब इन लोगों ने सुप्रीम कोर्ट का दरवाजा खटखटाया, तो सर्वोच्च न्यायालय ने इस प्रक्रिया को स्वीकार कर लिया।

बिहार में 5.5 लाख राशन कार्ड धारकों के नाम इस प्रक्रिया के तहत रद्द कर दिए गए हैं। सरकारी अधिकारियों का कहना है कि यह एक वैध कदम है, ताकि कल्याण योजनाओं का लाभ केवल योग्य लोगों तक पहुंचे। ऐसे में लाखों परिवारों को सरकारी सहायता से वंचित होने के चलते जीविकोपार्जन में दिक्कतों का सामना करना पड़ रहा है।

मृत मतदाताओं की संख्या बढ़ रही है

अव्वल डेटा के मुताबिक, वोटर लिस्ट से हटाए गए नामों में 66.88 लाख मृत मतदाता शामिल हैं। यूपी और पश्चिम बंगाल में सबसे ज्यादा संख्या दर्ज की गई है। इसके अलावा अन्य राज्यों में भी लोगों को अपनी पहचान साबित करने के लिए कठिनाइयों में डालने वाली समस्याएं सामने आई हैं।

एक पूर्व संपादक की व्यक्तिगत कहानी

The exercise forms a crucial part of updating and verifying electoral rolls ahead of future elections.

State Chief Electoral Officer RS Gopalan thanked Pattnaik for using his art to support the voter awareness campaign. He said the administration appreciated the artist’s efforts in encouraging public participation in the electoral roll revision process.

House-To-House Verification Begins Across State

Speaking to reporters, Gopalan detailed the schedule of the Special Intensive Revision and urged voters to cooperate with election officials during the month-long exercise.

He said BLOs would conduct house-to-house visits between May 30 and June 28 and would also remain available at polling booths every evening from 3 pm to 5 pm. Their responsibility is to distribute enumeration forms to all voters listed in the 2025 electoral roll, assist in the completion of forms and collect the documents for verification.

According to election officials, the information gathered during the exercise will be used to update electoral records and ensure the accuracy of voter lists. The revision process aims to identify eligible voters, remove inaccuracies and maintain an up-to-date electoral database.

The CEO further said that once the forms are collected, the draft electoral roll will be published on July 5. Citizens will then be able to submit claims and objections regarding entries in the roll until August 4.

Claims And Objections Process To Follow Draft Publication

After the claims and objections period closes, election authorities will conduct hearings and inquiries into all submissions. The process of examining and disposing of claims and objections will continue for nearly a month before the final electoral roll is prepared.

The final revised electoral roll is scheduled to be published on September 6, 2026.

Meanwhile, Dibya Jyoti Parida said the district administration had made all necessary arrangements to facilitate the exercise in Puri. He appealed to voters to extend full cooperation to BLOs during their visits and ensure that the required information is provided accurately in the enumeration forms.

Odisha Among States Undergoing Intensive Electoral Roll Revision

The Special Intensive Revision programme is also being carried out in Mizoram, Sikkim and Manipur. For these states, the qualifying date for the revision exercise has been fixed as July 1, 2026.

The preparatory phase, including training and printing of materials, was conducted between May 20 and May 29. Alongside voter verification, the rationalisation of polling stations is also scheduled to be completed by June 28.

Election officials said the exercise is aimed at strengthening the integrity of the electoral process by ensuring that voter rolls remain accurate, transparent and inclusive. Authorities have urged all eligible voters to participate actively in the revision process and respond promptly when approached by BLOs during the ongoing verification drive.

Consequently, the decision raises substantial concerns regarding the status of numerous voters whose names were deleted during this revision.

Mechanisms for Deleted Voters’ Claims

The SIR includes provisions for claims and objections, allowing those whose names are missing from the draft rolls the opportunity to file claims and provide documentation to the Electoral Roll District Magistrate (ERDM) prior to the final list’s publication. In regions where the SIR has concluded, significant numbers of claims have already been processed. Notably in West Bengal, the Supreme Court established a special appeals mechanism, appointing retired High Court judges to adjudicate over 34 lakh claims related to voter verification.

As the state prepared for elections, over 1,600 names were reinstated to the voter list, while as of May 14, around 4,043 appeals had been accepted by legal tribunals, with ongoing adjudication processes. These developments illustrate the complexities surrounding voter registration and the resolutions available to those impacted.

Furthermore, the Supreme Court instructed the EC to refer deleted names based on suspected citizenship issues to the appropriate authority within a four-week timeframe. This raises queries regarding the identification of this authority within the broader context of citizenship verification in India.

Role of the Ministry of Home Affairs

Under current Indian law, the Ministry of Home Affairs (MHA) is designated as the competent authority to assess citizenship matters. Citizenship can be acquired through various means including birth, descent, and naturalisation. Individuals born in India between certain dates automatically acquire citizenship, while those born of Indian citizen parents outside of India can claim citizenship through descent.

For individuals born after a specified date, citizenship by birth requires both parents to be Indian citizens at the time of birth, or one citizen parent and the other not being an illegal migrant. Naturalisation is an option for foreigners who meet particular residency requirements. The MHA takes into account relevant documentation such as birth certificates and school records when verifying citizenship status.

The MHA employs mechanisms to certify citizenship claims and has previously issued certificates verifying an individual’s status as a bona fide citizen. For individuals referred to the MHA by the EC, the documentation they present will undergo scrutiny to ascertain their citizenship claims, emphasising the procedural integrity required in these cases.

Before the implementation of the National Register of Indian Citizens (NRIC) framework in 2004, there had been little precedent for mass citizenship verifications of individuals alleged to be illegal immigrants. Existing procedures typically involve local police and the Foreigners Regional Registration Office (FRRO) managing such cases. The complexities of these procedural frameworks highlight issues that have emerged in light of the Supreme Court’s ruling.

Future Steps for Deleted Voters

The deletion of lakhs of names from the electoral rolls has led to significant uncertainty regarding the next steps for these individuals. It remains to be seen how the MHA will handle verification and whether additional Foreigners Tribunals will be established to address the matter. Such developments will likely shape the landscape of citizenship verification in India going forward.

Reportedly, the existence of over 100 foreigner tribunals, primarily set up in Assam during prior NRC processes, adds another layer of complexity to the current situation. As of December 2020, more than 1,40,050 cases awaited resolution in these tribunals, illustrating the backlog present even before the recent Supreme Court directive.

The fate of individuals classified as foreigners is also a pressing concern, as they face the apprehension of being stripped of various rights and benefits while their citizenship claims are adjudicated. This situation necessitates careful management by both the MHA and affiliated authorities to ensure fairness and legality in citizenship verification procedures.
