Supreme Court Declines Request to Reopen CBSE Re-Evaluation Window

The Supreme Court has decided against reopening the re-evaluation window for Central Board of Secondary Education (CBSE) results. This ruling, issued on Tuesday, was communicated by Chief Justice of India Surya Kant, who informed students that the court could not assist them at this stage for missing the deadline.

This plea comes amidst ongoing discussions regarding CBSE’s On-Screen Marking (OSM) system. The Court has previously sought responses from the Government of India and CBSE concerning complaints related to evaluation processes and a grievance window that was available for one week.

According to reports, approximately 1.68 lakh students utilized the grievance window, which allowed them to raise concerns about their results. However, many students expressed dissatisfaction, noting that they were unable to seek redress due to timing issues.

Responses from the Chief Justice

During the proceedings, Chief Justice Surya Kant raised questions regarding the number of students who were able to file for re-evaluation while the application window was open. He questioned, “If so many students managed to file applications, why did you not file it in time when the window was open?”

The court reiterated that those who did not apply within the specified timeframe could not request a reopening of the evaluation process at such a late date. The CJI emphasised the importance of adhering to deadlines in legal matters.

Furthermore, the Chief Justice pointed out that students had missed out on the opportunity to apply in a timely manner, which led to the court’s inability to assist them now. “You missed the bus. It’s your bad luck. What can we do?” he stated, highlighting the limitation of the court’s power in this instance.

Ongoing Concerns over CBSE Evaluation Process

The Supreme Court’s ruling confirmed that the re-evaluation window would remain closed at this point, reinforcing that students who failed to meet the application deadline could not request an extension through a court order. This decision serves to underline the importance of formal processes, particularly when it comes to educational evaluations.

The court reiterated its previous stance that petitions concerning CBSE results and re-evaluation issues are routinely filed each year. It was recalled that a similar request for intervention had been dismissed in the prior year, establishing a precedent regarding the reopening of evaluation cases.

As the discussions about the OSM evaluation system continue, the Supreme Court has also highlighted the necessity for CBSE to safeguard the interests of affected students. The court’s scrutiny remains focused on ensuring transparency and fairness within the evaluation framework.
