The various arrivals each day were managed meticulously, as actors travelled in separate vehicles and technicians had their own arrangements. In its statement, Puja Entertainment has sought an urgent injunction to halt the film’s release, distribution, and any form of commercial exploitation that involves the disputed songs. The court has reportedly accepted the filing for proceedings and will be holding a hearing soon.

Relief Sought by Puja Entertainment

Beyond seeking an injunction against the production’s use of the songs, Puja Entertainment is demanding the removal of ‘Chunari Chunari’ and ‘Ishq Sona Hai’ from both the film and its promotional materials. Additionally, the production house is requesting a change in the title of the film, currently named Hai Jawani Toh Ishq Hona Hai.

Puja Entertainment has also specified a claim for an extra Rs. 100 crore in damages should the opposing parties, including Tips Industries and David Dhawan, disregard their requests and continue using the contested works. The production company argues that the defendants have inappropriately capitalised on noteworthy intellectual property rights without possessing the necessary authority or licenses to utilise the original audiovisual content commercially.

The legal arguments presented by Puja Entertainment contend that such alleged infringement undermines the fundamental proprietary and commercial rights linked to the original cinematographic works from the late 1990s cinema scene.

Status of the Legal Proceedings

Leading Counsel V K Dubey is representing Puja Entertainment in this case. According to a press statement, Dubey confirmed that following a review of the situation, the Bombay High Court has decided to schedule the hearing for the matter soon, adding that it currently stands sub judice.

The lawsuit potentially marks an important chapter in the realm of Bollywood copyright disputes, given the high-value claim and the iconic nature of the songs involved. The upcoming court hearing may set significant precedents for similar cases in the Indian film industry.
