										<content:encoded><![CDATA[<h5>सुप्रीम कोर्ट ने मुफ्त सुविधाओं यानी &#8216;फ्रीबीज&#8217; पर गहरी चिंता जताई है। चीफ जस्टिस ने कहा कि घाटे में चल रहे कई राज्य मुफ्त भोजन, बिजली और साइकिल जैसी योजनाएं दे रहे हैं, जिससे देश के आर्थिक विकास में बाधा आ रही है। कोर्ट ने इस पर गंभीर चेतावनी दी है कि जब राज्यराजस्व घाटे में हैं, तो फिर भी ये सुविधाएं कैसे उपलब्ध कराई जा रही हैं।</h5>
<h2>फिजूलखर्ची की चेतावनी</h2>
<h5>सीजेआई ने स्पष्टता से कहा कि इस तरह की फिजूलखर्ची से विकास के लिए कोई संसाधन नहीं बचता। उन्होंने कहा कि क्या यह संभव है कि सालाना जो राजस्व इकट्ठा किया जाता है, उसका 25 प्रतिशत विकास कार्यों में क्यों नहीं लगाया जा सकता? इस पर सोचने की जरूरत है।</h5>
<h2>राज्य और रोजगार के अवसर</h2>
<h5>सीजेआई ने कहा कि राज्यों को रोजगार के अवसर बढ़ाने पर ध्यान देना चाहिए। मुफ्त योजनाओं में लिप्त होने के बजाय, सरकारों को नौकरी निर्माण पर ध्यान केंद्रित करना चाहिए। अगर सुबह से ही मुफ्त भोजन देना होगा, फिर मुफ्त साइकिल और फिर मुफ्त बिजली, तो यह कैसे संभव है कि विकास कार्यों में कोई निवेश हो सके?</h5>
<h2>पैसे का स्रोत जानने की आवश्यकता</h2>
<h5>सीजेआई ने स्पष्ट किया कि राज्यों को यह बताना चाहिए कि ये मुफ्त सुविधाएं कैसे वित्त पोषित की जाएंगी। क्या यह टैक्स का पैसा नहीं है, जो आम जनता से लिया जाता है? अगर ऐसा है, तो यह प्रवृत्ति कब तक चलती रहेगी? यह एक गंभीर सवाल है।</h5>
<h2>चुनावों के निकट मुफ्त योजनाएं</h2>
<h5>मुख्य न्यायाधीश ने यह भी कहा कि चुनाव से पहले कई ऐसी योजनाएं क्यों घोषित की जाती हैं, इस पर भी गहन विचार करना आवश्यक है। यह सभी राजनीतिक दलों के लिए एक चुनौती है कि वे इस बात के बारे में सोचें कि आखिर क्यों और कैसे इस तरह की योजनाएं लागू की जा रही हैं।</h5>
<h2>बड़े जमींदारों को भी मिलती हैं सुविधाएं</h2>
<h5>सीजेआई ने एक महत्वपूर्ण बिंदु उठाया कि कई राज्यों में बड़े जमींदारों को भी मुफ्त बिजली मिलती है। क्या यह उचित है कि ऐसे लोगों को भी मुफ्त में सुविधाएं दी जाएं, जो पहले ही आर्थिक रूप से सक्षम हैं? इस पर विचार करने की आवश्यकता है।</h5>
<h2>राज्य के कर्तव्य का निर्वहन</h2>
<h5>हालांकि, कोर्ट ने माना कि यह राज्य का कर्तव्य है कि वह अपने नागरिकों को बुनियादी सुविधाएं उपलब्ध कराए, लेकिन क्या ये सुविधाएं सही लोगों तक पहुंच रही हैं? यह एक महत्वपूर्ण सवाल है। सरकार को इस पर ध्यान देने की आवश्यकता है।</h5>

										<content:encoded><![CDATA[<h4><span style="font-weight: 400;">In a deeply emotional hearing on Thursday, the Supreme Court confronted the shocking reality that the trial of a woman attacked with acid in 2009 is still unfinished. The revelation came directly from survivor Shaheen Malik, who stood before the Bench of Chief Justice of India Surya Kant and Justice Joymalya Bagchi to describe how her fight for justice has dragged on for 16 years.</span></h4>
<h1><span style="font-weight: 400;">Survivor Says Her Case Barely Moved for Years</span></h1>
<h4><span style="font-weight: 400;">Malik explained that she spent years watching her file gather dust. “Mere saath 2009 mein attack hua tha, abhi tak trial chal raha hai,” she told the judges, noting that between 2009 and 2013 there was virtually no progress. She said the trial, now at the stage of final arguments in a Rohini court, only picked up again when a judicial officer, Dr. Parminder Kaur, revived the matter.</span></h4>
<h4><span style="font-weight: 400;">Her counsel added that others who suffered similar attacks face devastating consequences: “There are others who are made to drink acid and they suffer equally. They are made to eat food by food pipe.”</span></h4>
<h1><span style="font-weight: 400;">Court Expresses Outrage Over Delay</span></h1>
<h4><span style="font-weight: 400;">The Chief Justice reacted strongly to the disclosure, questioning how a case of such brutality could be left unresolved for so long especially in the nation’s capital. “The offence is of 2009 and the trial is not completed! If the National Capital cannot respond to these challenges, then who will deal with it? It is a shame on the system!” he said.</span></h4>
<h4><span style="font-weight: 400;">Calling the situation “a mockery of the system,” the CJI asked Malik to file an application so the Supreme Court could directly push for the case to be concluded.</span></h4>
<h1><span style="font-weight: 400;">SC Orders Nationwide Data Collection on Acid Attack Trials</span></h1>
<h4><span style="font-weight: 400;">Shocked by the length of Malik’s wait, the Court expanded its focus beyond her case. It directed all High Courts to compile and submit information on every pending acid attack trial across their jurisdictions. The Bench issued notice and asked the Registrar Generals of all High Courts to furnish the data before the next hearing.</span></h4>
<h1><span style="font-weight: 400;">Solicitor General Supports Strong Action</span></h1>
<h4><span style="font-weight: 400;">Solicitor General Tushar Mehta, who was present in court, agreed that the system had failed survivors. He said perpetrators deserved no leniency: “The perpetrator should meet with the same ruthlessness as done here. No agency can oppose this.”</span></h4>
<h4><span style="font-weight: 400;">He also backed the idea of treating severe acid attack cases particularly incidents involving forced ingestion as disabilities under the Rights of Persons with Disabilities Act, 2016. “I don’t think any respondent can oppose this. It should be treated as disability. They should be considered in the Act,” he said.</span></h4>
<h1><span style="font-weight: 400;">CJI Calls for Government Intervention</span></h1>
<h4><span style="font-weight: 400;">The Chief Justice urged the Centre to step in decisively: “Mr. Solicitor General, do something… The definition of ‘disabled’ can include them as well. There can be an ordinance. This (the delay in criminal trial) is a mockery of the system.”</span></h4>
<h4><span style="font-weight: 400;">He also remarked that such offences may require dedicated courts: “There should be no sympathy for such persons (accused).”</span></h4>
<h1><span style="font-weight: 400;">PIL Points to Legal Gaps Affecting Acid Ingestion Survivors</span></h1>
<h4><span style="font-weight: 400;">The petition filed through AoR Anuj Kapoor highlights a loophole in the disability law, which restricts recognition to survivors whose bodies were disfigured by acid being thrown. Those forced to drink acid who may live with lifelong internal injuries, need feeding pipes, and lose mobility do not qualify for disability certificates, cutting them off from essential rehabilitation and financial support.</span></h4>
<h4><span style="font-weight: 400;">These concerns, raised before the Bench, reinforced the need for reforms that Malik’s PIL seeks, including amendments to the RPwD Act.</span></h4>
<h1><span style="font-weight: 400;">Case to Be Taken Up Again Next Week</span></h1>
<h4><span style="font-weight: 400;">The Court will revisit the matter next week as it waits for data on acid attack trials nationwide and considers measures to accelerate pending cases and strengthen protections for survivors.</span></h4>

<h1><span style="font-weight: 400;">A Judicial Career Shaped Across Courts and States</span></h1>
<h4><span style="font-weight: 400;">Justice Kant’s legal journey began in Hisar, where he was born on February 10, 1962, and where he completed early studies before earning his law degree from Maharshi Dayanand University in 1984. He entered the profession the same year at the Hisar district court and expanded his practice in Chandigarh from 1985, focusing heavily on constitutional and service matters.</span></h4>
<h4><span style="font-weight: 400;">His rise was rapid: in 2000, he became Haryana’s youngest Advocate General, followed by his designation as a senior advocate the next year. His judicial appointments began with the Punjab and Haryana High Court in 2004, progressing to the role of Chief Justice of the Himachal Pradesh High Court in 2018. He joined the Supreme Court in May 2019.</span></h4>
<h4><span style="font-weight: 400;">Along the way, he pursued higher studies, completing his Master’s in Law from Kurukshetra University in 2011, where he secured the top position in his batch with “first class first”.</span></h4>
<h1><span style="font-weight: 400;">Important Verdicts and National Impact</span></h1>

<h4><span style="font-weight: 400;">Justice Kant has also ruled on matters touching gender rights and grassroots governance including restoring a woman sarpanch unlawfully removed from office and directing that one-third of seats in bar associations, including the SCBA, be reserved for women lawyers.</span></h4>
<h4><span style="font-weight: 400;">His bench upheld the One Rank-One Pension (OROP) scheme as constitutionally sound, and he continues to hear matters concerning the grant of permanent commission to women officers in the armed forces.</span></h4>
<h4><span style="font-weight: 400;">Additionally, he took part in the bench that overturned the 1967 AMU judgment, reopening the debate on the university’s minority status.</span></h4>
<h1><span style="font-weight: 400;">Role in Investigations and Sensitive Cases</span></h1>
<h4><span style="font-weight: 400;">Justice Kant has handled multiple cases involving national security and institutional accountability. In the Pegasus spyware matter, he reiterated that the state cannot seek a “free pass under the guise of national security.” His bench also appointed the committee led by Justice Indu Malhotra to examine the 2022 security lapse during Prime Minister Narendra Modi’s visit to Punjab, observing that such matters require “a judicially trained mind.”</span></h4>
<h1><span style="font-weight: 400;">Philosophy and Administrative Agenda as CJI</span></h1>
<h4><span style="font-weight: 400;">On the eve of taking charge, Justice Kant outlined his priorities, stressing the need to address the Supreme Court’s mounting docket of nearly 90,000 cases. His immediate focus, he said, is on improving how judicial manpower is deployed and ensuring older cases are taken up swiftly.</span></h4>
<h4><span style="font-weight: 400;">He noted that delays in the Supreme Court often hold up cases in lower courts and emphasised the importance of reviving the practice of approaching subordinate courts first.</span></h4>
<h4><span style="font-weight: 400;">Reflecting on the values that guide him, he said, </span><span style="font-weight: 400;">“A farmer’s patience taught me that true growth requires time, care and resilience… Justice, like a harvest, cannot be forced; it must be cultivated with diligence and respect for the natural rhythm of due process.”</span></h4>
<h4><span style="font-weight: 400;">To this, he added that “a poet’s empathy” enables him to appreciate the human realities beneath the legal issues in each case.</span></h4>
<h4><span style="font-weight: 400;">Calling his approach “humanistic,” he stressed the importance of consistency, neutrality and awareness of social context in judicial decision-making. He also underlined the need for robust administrative discipline, noting that courts function as collective institutions requiring efficiency and cohesion.</span></h4>
<h1><span style="font-weight: 400;">Mediation and Modernisation as Key Reforms</span></h1>
<h4><span style="font-weight: 400;">Justice Kant has placed mediation at the centre of his reform roadmap. He described it as a practical solution with the potential to ease pressure on courts, remarking, “We must identify a solution, and one of the easiest solutions, which can be a game changer, is mediation.”</span></h4>
<h4><span style="font-weight: 400;">Technology upgrades, better procedural systems, and improvements in infrastructure are also part of his agenda. He believes even incremental changes such as stronger process guidelines and digital integration can bring transformative benefits.</span></h4>
<h4><span style="font-weight: 400;">As the Executive Chairman of NALSA, Justice Kant recently launched the Veer Parivar Sahayata Yojana 2025, which provides free legal support to soldiers, veterans and their families.</span></h4>

										<content:encoded><![CDATA[<h4>Marking a significant moment in Indian judicial history, Justice Bhushan Ramkrishna Gavai officially took charge as the 52nd Chief Justice of India (CJI) on Wednesday. Administered the oath of office by President Droupadi Murmu at Rashtrapati Bhavan, Justice Gavai became the first Buddhist to ascend to the highest judicial post in the country.</h4>
<h4>A seasoned judge with over three decades of experience, Justice Gavai is expected to serve as CJI until November 23, 2025. Though his term spans just over six months, he brings a robust legacy of judicial contributions, having delivered more than 300 judgments and participated in around 700 benches.</h4>
<h4>Justice Gavai’s elevation also revives the representation of the Scheduled Caste community in the Supreme Court, a gap that lasted for nearly a decade before his appointment in 2019. His legal journey began in 1985 at the Nagpur Bench of the Bombay High Court, where he practiced in constitutional and administrative law. He was appointed an Additional Judge in 2003 and became a Permanent Judge in 2005.</h4>

<h4>Following the swearing-in, the new CJI was seen warmly greeting dignitaries, including Prime Minister Narendra Modi, Union Ministers Amit Shah and Arjun Ram Meghwal, as well as his predecessor, Justice Sanjiv Khanna. A poignant moment occurred when Justice Gavai touched his mother&#8217;s feet, and the Prime Minister greeted her with folded hands.</h4>
<h4>Justice Gavai is known for being candid and firm in his judgments. His involvement in landmark cases includes the upholding of Article 370’s abrogation, striking down the electoral bonds scheme, and fortifying personal liberty rights in the Manish Sisodia bail judgment. He also led the bench that released Perarivalan, convicted in the Rajiv Gandhi assassination case.</h4>
<h4>Soon after the ceremony, Justice Gavai convened at the Supreme Court for a brief interaction with colleagues. A full judges&#8217; meeting is expected to be held soon to discuss administrative matters and the direction of the judiciary under his leadership. The Court will go into partial recess in 10 days for the annual summer break, with limited benches continuing hearings.</h4>
<h4>Looking beyond Gavai&#8217;s term, the Supreme Court is set for a historic milestone. On September 27, 2027, Justice BV Nagarathna is poised to become the first woman Chief Justice of India making her appointment a landmark moment in the judiciary’s 75-year history. Though her tenure will last only 36 days, it will not be the shortest ever. That record is held by Justice Kamal Narain Singh, who served for just 17 days.</h4>

<h4>Justice Nagarathna’s appointment, if based on the seniority principle currently followed in judicial elevations, would also mark India’s second-ever father-daughter duo to serve as CJIs. Her father, Justice E.S. Venkataramiah, served as the 19th CJI in 1989.</h4>
<h4>Despite the significance of her future appointment, Justice Nagarathna’s brief tenure has reignited the debate over the need for longer terms for CJIs. Former CJI P. Sathasivam, who held the post for about nine months, had voiced concerns that short tenures prevent meaningful institutional reforms.</h4>
<h4>The issue of brief terms extends beyond the Supreme Court. Former CJI D.Y. Chandrachud’s appointment of eight High Court Chief Justices highlighted the same problem, with some of them, including Chief Justice Rajiv Shakdher, serving less than a month.</h4>
<h4>Meanwhile, women’s representation in the higher judiciary remains limited. Following Justice Hima Kohli’s retirement in 2024, only two women Justice BV Nagarathna and Justice Bela M. Trivedi serve among the 34 Supreme Court judges. According to the India Justice Report 2025, only 14% of High Court judges are women, signaling slow progress unless the appointment system is reformed.</h4>
<h4>Interestingly, Justice Fathima Beevi, the first woman appointed to the Supreme Court in 1989, served only two and a half years, the shortest among women justices. In contrast, Justice Nagarathna is projected to complete six years and two months on the bench, the longest tenure for a woman in the apex court’s history.</h4>
<h4>As Justice Gavai takes on his new role, the spotlight is not just on his tenure but on broader issues of judicial reforms, representation, and the future shape of India’s top court.</h4>

<h5>जब उनसे पूछा गया कि क्या वे अपने पिता की तरह राजनीति में शामिल होंगे, तो न्यायमूर्ति गवई ने कहा, &#8220;कोई राजनीतिक महत्वाकांक्षा नहीं है। मैंने सेवानिवृत्ति के बाद कोई कार्यभार या पद नहीं लेने का फैसला किया है। कोई भी अन्य कार्यभार सीजेआई पद से नीचे है, राज्यपाल भी सीजेआई पद से नीचे है।&#8221;</h5>
<h2>कौन हैं BR Gavai?</h2>
<h5>न्यायमूर्ति BR Gavai प्रसिद्ध राजनीतिज्ञ RS गवई के पुत्र हैं, जो बिहार और केरल के राज्यपाल थे। वे एक ऐसे परिवार से ताल्लुक रखते हैं जो बीआर अंबेडकर के आदर्शों को बढ़ावा देने में गहराई से लगा हुआ है। उनके पिता एक प्रमुख अम्बेडकरवादी और पूर्व संसद सदस्य थे। महाराष्ट्र के एक गांव में जन्मे न्यायमूर्ति गवई ने कहा कि उन्हें अब भी साल में तीन बार अपने गांव जाना पसंद है, खास तौर पर अपने दिवंगत पिता की जयंती और पुण्यतिथि पर और अपने गांव में होने वाले वार्षिक मेले के दौरान।</h5>
<h2>1985 में बार के मेंबर</h2>
<h5>24 नवंबर, 1960 को अमरावती में जन्मे न्यायमूर्ति गवई 16 मार्च, 1985 को बार में शामिल हुए और बॉम्बे हाई कोर्ट और बॉम्बे हाई कोर्ट की नागपुर बेंच में अपनी प्रैक्टिस शुरू की। उन्हें 17 जनवरी, 2000 को नागपुर बेंच के लिए सरकारी वकील और लोक अभियोजक नियुक्त किया गया था। उन्हें 14 नवंबर, 2003 को उच्च न्यायालय के अतिरिक्त न्यायाधीश के रूप में पदोन्नत किया गया और नवंबर 2005 में बॉम्बे उच्च न्यायालय के स्थायी न्यायाधीश बने। न्यायमूर्ती गवई को 24 मई, 2019 को भारत के सर्वोच्च न्यायालय के न्यायाधीश के रूप में पदोन्नत किया गया।</h5>
<h2>700 से ज्यादा बेंच का रहे हैं हिस्सा, 6 महीने का है कार्यकाल</h2>
<h5>पिछले छह वर्षों में, वे संवैधानिक और प्रशासनिक कानून, नागरिक कानून, आपराधिक कानून, वाणिज्यिक विवाद, मध्यस्थता कानून, बिजली कानून, शिक्षा मामले, पर्यावरण कानून आदि सहित विभिन्न विषयों से संबंधित मामलों से निपटने वाली लगभग 700 पीठों का हिस्सा रहे हैं।  न्यायमूर्ति गवई 23 नवंबर, 2025 को सेवानिवृत्त होंगे।</h5>

<h2>कौन हैं जस्टिस गवई?  Who is Chief Justice of India</h2>
<h5>जस्टिस गवई को 24 मई 2019 को सुप्रीम कोर्ट का जज नियुक्त किया गया था। उनका जन्म 24 नवंबर को महाराष्ट्र के अमरावती में हुआ था। वे दिवंगत आर.एस. गवई के बेटे हैं, जो बिहार और केरल के राज्यपाल रह चुके हैं। बॉम्बे हाईकोर्ट में एडिशनल जज के रूप में उन्होंने 14 नवंबर 2003 को अपनी न्यायिक करियर की शुरुआत की थी। बतौर जज वो मुंबई, नागपुर, औरंगाबाद और पणजी के विभिन्न पीठों पर काम कर चुके हैं।</h5>

										<content:encoded><![CDATA[<h4><span data-preserver-spaces="true">The process for India’s top judicial post is officially underway</span><span data-preserver-spaces="true">, with the name of</span><span data-preserver-spaces="true"> Justice Bhushan Ramkrishna Gavai </span><span data-preserver-spaces="true">being put forward</span><span data-preserver-spaces="true"> to become the 52nd Chief Justice of India.</span><span data-preserver-spaces="true"> His nomination follows the formal recommendation </span><span data-preserver-spaces="true">made by current</span><span data-preserver-spaces="true"> Chief Justice Sanjiv Khanna, who is retiring on May 13.</span></h4>
<h4><span data-preserver-spaces="true">Justice Gavai is expected to be sworn in as Chief Justice on May 14, and if appointed, will serve in the role until November 2025, giving him a brief tenure of just six months at the helm of the judiciary.</span></h4>
<h1>Justice Gavai, Second Judge to Serve from SC Tribe</h1>
<h4><span data-preserver-spaces="true">The Union Law Ministry </span><span data-preserver-spaces="true">had earlier</span><span data-preserver-spaces="true"> initiated the appointment process by requesting the sitting Chief Justice to name his successor. As per established practice, the senior-most judge in line is typically chosen for the post, and Justice Gavai fits that criterion.</span></h4>
<h4><span data-preserver-spaces="true">With this elevation, Justice Gavai will become only the second judge from the Scheduled Caste community to serve as the Chief Justice of India, following Justice KG Balakrishnan, who held the post from 2007 to 2010.</span></h4>
<h4><span data-preserver-spaces="true">Justice Gavai&#8217;s judicial career spans over two decades. After completing his law degree, he began his legal journey in 1985 and soon started working with Raja S Bhonsale, a former Advocate General and High Court Judge. He began practicing independently in the Bombay High Court in 1987, later shifting his focus to the Nagpur Bench, where he specialised in constitutional and administrative law. Over the years, he also represented civic bodies and government entities such as the Municipal Corporations of Nagpur and Amravati, as well as Amravati University.</span></h4>
<h1>Justice Gavai&#8217;s Experience</h1>
<h4><span data-preserver-spaces="true">His experience as a public counsel includes roles as Assistant Government Pleader and Additional Public Prosecutor from 1992, followed by his promotion to Government Pleader and Public Prosecutor in 2000. Justice Gavai was appointed as an Additional Judge of the Bombay High Court in November 2003 and became a Permanent Judge in 2005.</span></h4>
<h4><span data-preserver-spaces="true">During his 15-year tenure at the Bombay High Court, he served </span><span data-preserver-spaces="true">at</span><span data-preserver-spaces="true"> various benches Mumbai, Nagpur, Aurangabad, and Panaj</span><span data-preserver-spaces="true">i </span><span data-preserver-spaces="true">b</span><span data-preserver-spaces="true">efore</span><span data-preserver-spaces="true"> being elevated to the Supreme Court of India in May 2019.</span></h4>
<h4><span data-preserver-spaces="true">Justice Gavai has participated in several landmark rulings </span><span data-preserver-spaces="true">during his time</span><span data-preserver-spaces="true"> on the apex court. He was part of the Constitution Bench that upheld the 2016 </span><span data-preserver-spaces="true">demonetisation</span><span data-preserver-spaces="true"> policy </span><span data-preserver-spaces="true">brought in</span><span data-preserver-spaces="true"> by the Modi government. In the majority opinion, he wrote that the move “satisfied the test of proportionality” and confirmed the Union government’s authority to invalidate currency.</span></h4>
<h1>Justice Gavai&#8217;s Past Life</h1>
<h4><span data-preserver-spaces="true">Another significant judgment under his name declared that state authorities demolishing </span><span data-preserver-spaces="true">properties</span><span data-preserver-spaces="true"> of accused individuals without proper legal procedure was unconstitutional. The ruling emphasised the importance of due process, noting that &#8220;executive authorities cannot act as judges and execute demolitions without legal procedures.&#8221;</span></h4>
<h4><span data-preserver-spaces="true">He also served on the bench that recently struck down the Electoral Bonds Scheme, addressing concerns about </span><span data-preserver-spaces="true">lack</span><span data-preserver-spaces="true"> of transparency in political funding.</span></h4>
<h4><span data-preserver-spaces="true">Born on November 24, 1960, in Amravati, Maharashtra, Justice Gavai comes from a legacy of public service his father, RS Gavai, was a respected social activist and former Governor of Bihar and Kerala.</span></h4>
<h4><span data-preserver-spaces="true">With his appointment, Justice Gavai is poised to make judicial history not only because of his </span><span data-preserver-spaces="true">background,</span><span data-preserver-spaces="true"> but also due to the critical legal decisions that are likely to come before the court during his short term.</span></h4>
<h4><span data-preserver-spaces="true">“We dispose of the petition with a direction to the expert committee to prepare its recommendation and submit a report </span><span data-preserver-spaces="true">in that regard</span><span data-preserver-spaces="true"> at the earliest so that relying on the report, the necessary amendments can be given effect </span><span data-preserver-spaces="true">to</span><span data-preserver-spaces="true">. Let this exercise be taken within </span><span data-preserver-spaces="true">a period of</span><span data-preserver-spaces="true"> three months from today,” the Supreme Court noted in a related recent order.</span></h4>

										<content:encoded><![CDATA[<h6><span style="font-weight: 400;">The Supreme Court asked the Election Commission of India to ensure that polling data is not deleted from the election voting machines till they are being verified. The bench consisting of Chief Justice of India, Sanjeev Khanna, and Justice Dipankar Dutta said this while seeking the ECI’s response to a plea by NGLO Association for Democratic Reforms (ADR). NGO alleged that the ECI procedure for verification of EVM was not in accordance with the April 2024 order of the Supreme Court.</span></h6>
<h6><span style="font-weight: 400;">“What we intended was that if after the poles, somebody asked the engineer should come and certify that according to him in their presence, there is no tampering in any of the burnt memory or the microchips stock. That’s all.” said the chief justice of India and asked senior advocate Mahinder Singh appearing for the ECI, “Why do you erase the data?”</span></h6>
<h2><span style="font-weight: 400;">The Order Statement</span></h2>
<h6><span style="font-weight: 400;">In the April 26, 2024 order, the top court allowed candidates at positions second and third to get burnt memory on the microcontroller of 5% of the EVM per assembly segment, after being “checked and verified by a team of engineers from EVM manufacturers post the announcement of results”. The candidates can do so on a written request in exchange for a certain cost, yet to be notified by the election commission.</span></h6>
<h6><span style="font-weight: 400;">Advocate Prashant Bhushan appearing for ADR said that the election commission only does mock poles for verification of the EDM.</span></h6>
<h6><span style="font-weight: 400;">“ What we want is that somebody should examine the software and hardware of EVM to see whether they have any element of manipulation or not,” said Advocate Bhushan.</span></h6>

This came in response to a petition by the Association for Democratic Reforms (ADR), which asked the Election Commission of India (ECI) to ensure that no data is deleted or reloaded from EVMs once the votes are counted.</h6>

The Supreme Court sought clarification regarding the reasoning for data clearing and directing the Election Commission to guarantee that no additional information deletion would take place.</h6>
<h6>The Supreme Court had specified that they aim to safeguard election transparency by calling EVM verification after voting ended without causing any disruption to the counting process. The Apex Court stressed that election system credibility required proper verification methods to maintain its authenticity.</h6>
<h2>Next Hearing Scheduled for March 17</h2>
<h6>The Election Commission has received a 15-day deadline to file its response and their next hearing is set for March 17. The ruling underscores both the need to protect voting integrity and the requirement of total transparency throughout EVM handling.</h6>
