The judgement emphasised that &#8220;marriage is a partnership of equals and not a service contract.&#8221; This ruling was issued after the court heard an appeal against a Family Court order that had granted a divorce based on claims of cruelty.</h4>
<h1>Dismissal Of Allegations Of Cruelty</h1>
<h4>A division bench, comprising Justices Bharti Dangre and Manjusha Deshpande, set aside the previous Family Court decision that favoured the husband&#8217;s claims. The court firmly dismissed the husband’s argument that his wife&#8217;s alleged failure to manage household chores amounted to mental cruelty. It was asserted that such domestic duties should not be viewed as obligatory services that wives are required to fulfil.</h4>
<h4>The judges clarified that the Family Court had not sufficiently substantiated the husband&#8217;s claims of cruelty, thereby rendering its decision unjustifiable. The ruling serves to reinforce the principle that spouses should be treated as equals in a marriage, thereby reaffirming the significance of mutual respect and support.</h4>
<h4>This case originated from the couple’s marriage on February 28, 2002. Following the wedding, conflicts were reported to have arisen almost immediately. Although efforts at mediation were attempted in June 2002, the resolution was short-lived. On July 7, 2002, the wife left the matrimonial home to reside with her parents, leading the husband to file for divorce in 2004 on grounds of alleged cruelty.</h4>
<h1>Allegations Of Mental Cruelty And The Response</h1>
<h4>The husband accused the wife of displaying rude behaviour, neglecting household responsibilities, and disobeying his parents, which he claimed took a toll on his mental well-being. He also alleged that she threatened to take her own life in response to his divorce proceedings, intensifying the emotional strain he claimed to be experiencing.</h4>
<h4>In contrast, the wife refuted these allegations, asserting that she had faced persistent harassment from her husband and his family regarding dowry demands. She claimed her parents had invested significantly in the marriage and contended that the intimidation she faced included humiliation over minor issues and physical abuse, which led to her decision to leave the matrimonial home and file formal complaints against her husband.</h4>
<h1>Financial Considerations And Maintenance Ruling</h1>
<h4>During the legal proceedings, the Family Court had initially granted the wife interim maintenance in 2005, which remained in effect until the case concluded in 2010. The husband opposed her claim for permanent maintenance, arguing that she was financially self-sufficient, conducting art classes that focused on bridal saree decoration and other artistic pursuits.</h4>
<h4>However, the High Court argued that the assessment of the husband&#8217;s financial capacity should not be limited to the income reported in his tax returns. The court noted his professional qualifications as a chartered accountant, suggesting he had considerable earning potential. It highlighted that factors like overall circumstances and the standard of living should be taken into account when deciding maintenance payments.</h4>
<h4>Considering the significant rise in living costs and inflation rates over the years, the High Court decided to increase the maintenance amount, ordering the husband to pay his estranged wife Rs 20,000 per month. This ruling underlines the importance of ensuring a dignified standard of living for the wife in the current economic climate.</h4>

<h2>40 दिन बाद मिलेगा प्रमाणपत्र</h2>
<h5>ड्राफ्ट के मुताबिक विवाह प्रमाणपत्र आवेदन के 40 दिन बाद जारी होगा। नई प्रणाली के तहत एक ऑनलाइन पोर्टल विकसित किया जाएगा, जहां दूल्हा-दुल्हन, गवाहों का पूरा विवरण, फोटो और आधार कार्ड की प्रतियां अनिवार्य होंगी। नोटरी प्रक्रिया भी सभी पक्षों की मौजूदगी में कराई जाएगी।</h5>
<h2>सुरक्षा और जवाबदेही पर जोर</h2>
<h5>सरकार ने स्पष्ट किया कि शादी के बाद यदि दहेज या संपत्ति को लेकर उत्पीड़न की शिकायत आती है तो सख्त कार्रवाई होगी। प्रस्ताव पर विधानसभा में चर्चा हुई है और आम जनता से सुझाव व आपत्तियां मांगी गई हैं। अंतिम निर्णय जनमत के बाद लिया जाएगा।</h5>
<h2>अन्य राज्यों में भी बहस</h2>
<h5>गुजरात के इस प्रस्ताव ने हरियाणा और मध्य प्रदेश जैसे राज्यों में भी बहस तेज कर दी है, जहां लव मैरिज में पारिवारिक सहमति को लेकर मांग उठ चुकी है।</h5>
