Chief Justice of India Surya Kant is set to inaugurate the permanent Bench of the High Court of Jammu and Kashmir and Ladakh in Leh on Sunday. This development has been reported by the Press Trust of India, citing a senior official. The establishment of this Bench is expected to facilitate easier access to justice for residents, particularly those living in remote areas.

Significance for Local Residents

Ladakh Chief Secretary Ashish Kundra highlighted that the new Bench will significantly benefit individuals in far-flung regions who often encounter challenges in reaching higher courts. These challenges include difficult terrain, harsh weather conditions, and long distances. Kundra remarked that the establishment of the High Court Bench is a pivotal milestone for the region, especially for those who have historically struggled to access judicial institutions.

During a press conference held on Saturday, Kundra explained that the initiative is particularly important for those needing to file writ petitions or seek judicial relief. Previously, residents would have to travel to Srinagar or Jammu, but with the new Bench in Leh, this journey will no longer be necessary. He described the development as an extremely positive step towards making justice more accessible.

Kundra further noted that the initiative was realised within a span of two months and was not a demand raised by Ladakh representatives during discussions with the Centre. Instead, it is a unilateral initiative by the government of India, which acknowledges the unique challenges faced by the local population due to geographical constraints.

Attendees at the Inauguration

The inauguration will also be attended by Lieutenant Governor of Ladakh Vinai Kumar Saxena, along with four other judges from the Supreme Court. The Chief Justice of the High Court of Jammu and Kashmir and Ladakh, along with other High Court judges and the Attorney General of India, will also be present at the event. This gathering underscores the significance of the occasion and the commitment to enhancing the judicial framework in the region.

Kundra pointed out that it has been over 40 years since a sitting Bench has been established in this manner for any other High Court in India. He referenced the Gauhati High Court’s Benches in Arunachal Pradesh as a comparable example, while also mentioning previous arrangements in Gwalior.

Lieutenant Governor Saxena described the establishment of the permanent Bench as a “historic step” aimed at improving the accessibility of the justice delivery system in Ladakh. He expressed gratitude to President Droupadi Murmu, Prime Minister Narendra Modi, and Union Home Minister Amit Shah for their roles in strengthening the judicial framework within the Union Territory.

Regulatory Framework for the Bench

The regulatory framework that allows for the establishment of the permanent Bench came into effect on September 5. This regulation was promulgated by President Murmu on August 27, with the implementation date subsequently announced by the Administrator in the Official Gazette. The decision to set September 5 as the effective date was made by the Lieutenant Governor.

The establishment of the permanent Bench is aimed at reducing the need for Ladakh residents to travel to Srinagar or Jammu for court proceedings, particularly for writ petitions. This initiative is expected to significantly ease the burden on local residents, making the judicial process more efficient and accessible.

Overall, the creation of the High Court Bench in Leh represents a significant advancement in the judicial landscape of Ladakh, aiming to bring justice closer to the people and address the unique challenges faced by the region’s inhabitants.

The Gauhati High Court has mandated that the Assam government pay Rs 2 lakh in interim compensation to Mujammel Hoque. This decision follows the case of his wife, Mumtaz Begum, who was declared a non-citizen by a foreigners tribunal and subsequently expelled to Bangladesh without her family being notified. The directive was issued by a division bench consisting of Justices Kalyan Rai Surana and Susmita Phukan Khaund on September 3.

The court also involved the Ministry of External Affairs to assist in locating Mumtaz Begum in Bangladesh and facilitating her return. The judges noted that Mumtaz Begum was denied the opportunity to contest the tribunal’s ruling in the high court, a situation that raised concerns regarding her legal rights.

Citing a Supreme Court ruling, the bench underlined that Article 21 of the Constitution applies to all individuals, irrespective of their citizenship status, protecting life and personal liberty.

Background of Mumtaz Begum’s Case

Mumtaz Begum, who resides in Nagaon, was designated as a foreigner on June 6, 2019, in a case that dates back to 2015. In Assam, foreigners tribunals assess the citizenship status of individuals suspected of not being legal citizens. Following such declarations, if individuals do not appeal to the Gauhati High Court, they face repatriation through a process involving the Ministry of External Affairs.

An estimated 100 foreigners tribunals operate within Assam’s jurisdiction. Earlier, on April 20, the High Court had nullified the tribunal’s decision on the grounds of insufficient evidential discussion and instructed Mumtaz Begum to reappear before the tribunal by May 30.

Legal Proceedings and Court Observations

The high court’s order stated that, according to an affidavit filed by the BSF, Mumtaz Begum was returned to Bangladesh on June 14, 2026, at approximately 12:10 am in the Kalaincherra area of Cachar. The bench observed that the authorities had not provided a copy of the tribunal’s ruling of May 30 or informed her family about her arrest and expulsion, thereby denying her the chance to contest the decision.

In its ruling, the court commented that Mumtaz Begum was expelled from India without her family being made aware of her detention. As a temporary measure, it instructed the Assam government to provide Rs 2 lakh to the petitioner within 60 days and also allowed for the possibility of seeking further compensation through civil court proceedings.

The court required the Ministry of External Affairs to be added as a party to the case to facilitate Mumtaz Begum’s return and enable her to pursue legal avenues against the tribunal’s ruling. Moreover, it noted potential shortcomings in the behavior of tribunal officials for their delay in providing necessary documentation.

Recent events involving the Acting Chief Justice of the Rajasthan High Court have raised significant questions regarding the mechanisms in place for accountability within the judiciary. Allegations of misconduct have emerged, prompting a closer examination of how judges can be held responsible for their actions.

The complexities of judicial accountability are underscored by the challenge of addressing claims against individuals in positions of significant authority. The public and legal community are now inquiring about the procedures available to ensure transparency and integrity in the judicial system.

Concerns have escalated particularly when high-ranking officials are implicated, as the integrity of the entire judiciary can be called into question. This controversy may potentially necessitate a thorough investigation into the processes that govern judicial conduct.

Judicial Accountability Mechanisms in India

In India, there are various mechanisms designed to investigate allegations against judges, including an in-house inquiry system. This involves a process where complaints are assessed and dealt with internally, allowing for a degree of privacy and discretion until the matter gains public interest.

However, critics argue that the in-house mechanism may lack sufficient transparency, as it can sometimes lead to perceptions of a lack of accountability. The procedures may not be rigorous enough to adequately address serious misconduct allegations, potentially undermining public trust in judicial institutions.

In extreme cases, impeachment remains a constitutional provision to remove a judge from office, although this route is considered rare and complicated. The impeachment process requires a two-thirds majority in both Houses of Parliament, making it a high threshold for action against judges.

The barriers to initiating impeachment highlight the broader challenges faced when prosecuting allegations within the judiciary. Critics often call for reforms to streamline these mechanisms and enhance accountability measures.

The Impact of Public Perception on Judicial Accountability

Public perception plays an integral role in the ongoing discourse surrounding judicial accountability. The recent controversies can contribute to a growing sentiment of scepticism about the independence and integrity of the judiciary. When that perception is tarnished, it can have cascading effects on public confidence in legal proceedings.

Furthermore, heightened scrutiny from the media and civil society can also influence how judicial directives are executed. The involvement of these external entities can lead to increased dialogues about the need for reform in accountability practices.

The judiciary itself faces a dilemma in maintaining its autonomy while simultaneously addressing public concerns around accountability. Stakeholders within the legal system are contemplating how to balance these competing interests without compromising judicial independence.

Ultimately, the developments surrounding the Rajasthan High Court’s Acting Chief Justice may serve as a catalyst for necessary discussions regarding the adequacy and effectiveness of existing mechanisms aimed at upholding judicial standards and integrity.

The Punjab and Haryana High Court has put a hold on the appointment process for 454 Pharmacist (Pharmacy Officer) positions in Punjab. This decision follows a petition that challenges the recruitment process organised by Baba Farid University of Health Sciences (BFUHS).

This order was issued on August 10, indicating that the hiring activities associated with the university’s advertisement from June 11 have now been suspended. The court has stated that the recruitment process will remain on hold until the next scheduled hearing on September 17, 2026.

The case was presided over by Justice Sandeep Moudgil. During the hearing, lawyers representing the respondents informed the court that the recruitment had already been halted in light of the ongoing legal proceedings.

Allegations of Examination Irregularities

BJP MP Sambit Patra has suggested that the recruitment examination was marred by allegations of a paper leak. Patra accused the Aam Aadmi Party-led Punjab government of initially downplaying these claims as mere irregularities.

“Patra noted, “A few hours ago, the Punjab and Haryana High Court issued a significant decision. Last month, examinations for the pharmacy officer recruitment, which were conducted in July 2026 by BFUHS, were alleged to have involved a leak.” He expressed concern over the government’s initial stance on the issue.

According to Patra, the government took steps to suspend those allegedly involved in misconduct but failed to halt the examination process or conduct a fresh test. “They have claimed these were simply irregularities and that those responsible had been suspended, yet the examination continued,” he said.

Court’s Directives and Upcoming Hearing

The High Court’s ruling explicitly states that appointments for the 454 positions cannot proceed during the review of the ongoing petition. It has allowed the State and other related parties to provide their responses while mandating that any replies be submitted at least one week in advance of the next hearing.

This interim order will continue to be effective until the judiciary reconvenes on September 17. The court’s decision reflects ongoing concerns about the transparency and integrity of the recruitment process.

Patra also claimed that Punjab Chief Minister Bhagwant Mann had consistently denied the occurrence of a paper leak. “This demonstrates that both the Congress party and the Aam Aadmi Party possess double standards,” he remarked, emphasising the need for accountability in governance.

Byju Raveendran, the founder of Byju’s, has encountered a significant legal obstacle as the Singapore High Court did not grant his request to suspend a six-month prison sentence for alleged contempt of court. This ruling effectively bars him from returning to Singapore without the risk of incarceration. The court’s decision was rendered on July 9, following the original sentence that was imposed in May. Although a temporary stay was granted last month, this latest verdict reinstates the jail term, complicating Raveendran’s future travel plans.

The sentence relates to Raveendran’s previous legal disputes, which have been exacerbated by the declining fortunes of Byju’s. The company, once a leader in the edtech sector and operated by Think & Learn Pvt Ltd, has faced substantial difficulties, including allegations of lapses in corporate governance after a phase of rapid growth.

Currently, Raveendran is not in Singapore. His legal representative, J. Michael McNutt of the law firm Lazareff Le Bars, stated that the order does not have immediate implications unless Raveendran decides to enter Singapore. McNutt further explained that Raveendran could appeal the court’s decision at that time.

Implications of the Court’s Ruling

According to McNutt, the court’s order predominantly affects Raveendran’s ability to travel freely to Singapore. He emphasised that the entrepreneur denies having intentionally breached any court orders. McNutt confirmed that Raveendran plans to explore all legal avenues available to him. The legal team firmly maintains that their client did not intentionally infringe upon any court mandates.

Legal experts suggest that continuing legal action could further complicate Raveendran’s situation and Byju’s operational challenges. This case has gained attention not only due to the heavy fines involved but also owing to its implications for the edtech sector and bootstrapped startups.

The legal landscape is particularly intricate given the ongoing investigations and lawsuits related to Byju’s finances and operational integrity. As such, navigating these challenges will require substantial legal resources and strategy adjustments.

Ongoing Legal Challenges In Multiple Jurisdictions

Raveendran faces a multitude of legal battles beyond Singapore, with creditors and investors in different countries intensifying efforts to reclaim funds linked to the company’s financial instability. Reports indicate that in the United States, lenders are pursuing repayment connected to a defaulted loan totalling $1.2 billion. This debt plays a critical role in the growing financial woes surrounding Byju’s.

In addition to American creditors, Raveendran is also embroiled in litigation in Singapore. One significant claimant is a subsidiary of the Qatar Investment Authority (QIA), which had previously invested in Byju’s during a funding round when the company was facing layoffs. The QIA has welcomed the latest ruling from the Singapore High Court and plans to continue its legal pursuit against Raveendran.

The culmination of these challenges significantly highlights the precarious position of Byju’s as it strives to navigate its turbulent path in the market. Strategically, Raveendran’s legal and financial manoeuvres will determine not only his personal situation but also the broader implications for the company and the stakeholders involved.
