The Delhi High Court has issued a directive for the Delhi Police to ensure an adequate police presence near the home of a woman whose son is implicated in the Uttam Nagar Holi violence case. This order came on September 30 after the court reviewed CCTV footage which reportedly showed a violent attack on the petitioner’s residence by local residents.

Details of the Incident and Court’s Rationale

The alleged attack involved members of the local community, including relatives of a deceased individual linked to the case. In light of this situation, the mother of the accused approached the court requesting immediate police protection for herself and her family. Justice Girish Kathpalia, upon examining the CCTV evidence, acknowledged the seriousness of the circumstances, stating that the law would progress with respect to the FIR against the petitioner’s son, but added that protection was necessary for the family to prevent further violence.

Justice Kathpalia noted that the residence is located in a narrow lane, which could make police protection more manageable. He remarked, “It is not difficult to protect the same by deploying police officials in the lane itself.” The court ordered the police to maintain continuous surveillance in the area until the situation stabilises.

The High Court also required the Delhi Police to submit a status report within one week detailing the measures taken to ensure safety and security in the vicinity. This report should include documentary evidence demonstrating sufficient police deployment and any additional steps taken to avert future violence.

Responses from Legal Representatives and Police Officials

During the court proceedings, Senior Advocates Warisha Farasat and Abdul Gaffar represented the petitioner. They argued that the attack on her home escalated over the preceding two days, with local residents reportedly hurling stones and bricks, intensifying the need for urgent police intervention.

Inspector Mukesh Kumar from Uttam Nagar Police Station attended the hearing and assured the court that the police would implement necessary measures to prevent further incidents. He committed to ensuring that sufficient police personnel would be deployed in the area to maintain order and safety.

This case highlights the tension in the aftermath of the Uttam Nagar incident, as local emotions run high following the violence that transpired during the Holi celebrations. With the court’s intervention, authorities are expected to take significant measures to restore calm and provide protection to the petitioner and her family.

The Delhi High Court has recently issued a notice to prominent cab-hailing services, including Uber, Ola, and Rapido, along with the Central government and the Delhi government. This notice was prompted by a Public Interest Litigation (PIL) aimed at enhancing safety measures for women using app-based taxi and ride-hailing services. The case was presented before a Division Bench comprising Chief Justice Devendra Kumar Upadhyaya and Justice Tejas Karia, who indicated the need for accountability in safety protocols implemented by these private operators.

Court Proceedings and Allegations

The urgency of the matter was underscored during the court proceedings, where the petitioner, Aditya Sehgal, expressed concerns over the current state of safety protocols. His counsel reported that app-based companies operate more than two lakh cabs across the Delhi-NCR region. Allegations were made regarding the inadequate checking of drivers, particularly during night hours, suggesting that no verifications are performed after 8 pm or 9 pm. This raises the question of drivers’ sobriety and adherence to safety standards, especially in high-traffic locations like airports.

The PIL outlines several critical issues related to driver verification and the screening of criminal backgrounds, as well as driver and vehicle identification processes. Additionally, concerns regarding emergency response mechanisms, grievance redressal systems, and the collaboration between ride-hailing services and law-enforcement authorities were highlighted. These aspects underline the necessity for a more robust framework to protect passengers.

The court has instructed the concerned parties to submit their responses to the notice by December 16, as it prepares for further hearings. The bench’s decision reflects a commitment to ensuring that private transport operators are held accountable for their safety measures.

Key Recommendations of the PIL

The petition advocates for a series of comprehensive reforms aimed at improving safety standards within the ride-hailing domain. Notably, it requests that the identities of drivers and vehicles matched against the details shown on the applicant’s interface before a ride commences. Furthermore, passengers should be permitted to cancel rides without incurring penalties in cases where an unauthorised driver or vehicle substitution occurs, with such incidents categorised as safety concerns.

Moreover, the plea calls for the establishment of 24×7 command and control centres to efficiently manage SOS alerts. This proposed framework would allow for the sharing of essential information, including booking details, driver identity, vehicle registration, and real-time location, with emergency responders while adhering to relevant legal and privacy regulations.

Additional proposals include automated alerts triggered by significant or unexplained deviations from the designated route, alongside continuous gender-sensitivity training for drivers. Surveillance mechanisms are suggested for areas deemed vulnerable or isolated to enhance passenger safety further.

Specific Initiatives for Women’s Safety

In response to concerns surrounding women travelling alone, the petition also proposes a pool of verified female drivers. This would allow women to request or preferentially be assigned female drivers, subject to the availability of such services. The outlined measures aim to create a safer environment for women utilising ride-hailing services.

Furthermore, the establishment of a time-sensitive grievance redressal system is proposed to address complaints related to driver misconduct, harassment, assault, deviations from routes, unauthorised changes in drivers or vehicles, and failures within emergency-response systems. Additionally, the petition urges regular compliance reporting from app-based operators to ensure the uniform enforcement of safety measures across platforms active within Delhi.

The overarching goal of these initiatives is to create a safer travel experience for women, as well as to establish stricter standards and accountability mechanisms within the ride-hailing industry.

The Delhi High Court has denied the third bail application of student activists Umar Khalid and Sharjeel Imam in relation to the February 2020 riots in north-east Delhi. This case is tied to a larger conspiracy allegedly linked to the unrest, and the accusations fall under the Unlawful Activities (Prevention) Act (UAPA). The ruling was delivered by a bench comprising Justices Prathiba M Singh and Dinesh Bhatt.

In their judgment, the Court cited the need to adhere to the Supreme Court’s instruction from January 5. This ruling stipulates that Khalid and Imam may request bail only after the testimony of protected witnesses is complete or after a year has passed since the Supreme Court order—whichever occurs first.

The justices emphasised the principle of judicial discipline and reiterated that they were unable to alter the conditions placed upon the two accused individuals. This denial is particularly impactful considering the severe nature of the charges brought against Khalid and Imam.

Allegations of Conspiracy

Both Umar Khalid and Sharjeel Imam are accused of being key figures in orchestrating the riots that resulted in the deaths of 53 individuals and injuries to over 700 others. The unrest coincided with widespread protests against the Citizenship (Amendment) Act (CAA), 2019, and the National Register of Citizens (NRC). These developments have drawn significant public and media attention.

The investigation into the riots remains ongoing, with the Delhi Police’s Special Cell leading the probe. Other individuals, including activist Khalid Saifi and former AAP councillor Tahir Hussain, are also implicated in this alleged conspiracy. The case portrays a complex network of alleged coordination among various actors during a politically charged period.

Khalid and Imam initially sought relief from the trial court, which repeatedly dismissed their bail requests. Their applications were turned down for the third time on July 4. Following this, the activists escalated their plea to the Delhi High Court in hopes of securing their release.

Background and Arrests

Umar Khalid was taken into custody on September 13, 2020, while Sharjeel Imam was arrested approximately three weeks earlier on August 25, 2020. Both activists have since been facing serious accusations and have endured prolonged detention awaiting trial.

The Delhi Police has been vocal in its opposition to granting bail to the duo, alleging that they played pivotal roles in instigating the violence. This claim underscores the police’s assertion that the riots represent not only a breakdown of law and order but also a larger scheme of unrest tied to national politics.

As the situation unfolds, developments in this case continue to attract attention from various stakeholders, including political observers and human rights activists. The ongoing judicial process and the implications of the High Court’s ruling will likely shape public discourse surrounding the case and its broader socio-political context.

The Delhi High Court has issued a stay on the order by the Food Safety and Standards Authority of India (FSSAI) that prohibited Red Bull from labelling its beverage as an ‘energy drink.’ This legal intervention highlights the ongoing contention regarding marketing practices within the beverage industry.

This order by the FSSAI argued that the company was violating regulations by classifying its product in a manner that could mislead consumers. The court’s decision to pause this ruling enables Red Bull to continue its use of the controversial label while the case is examined further.

Legal experts suggest that such interventions are significant not only for the parties involved but also for the overarching framework guiding food and beverage regulation in India. The ruling has implications for how similar products may be marketed in the future.

Implications for Beverage Industry

The decision to pause the FSSAI’s order brings to light the complexities surrounding product classifications in the beverage sector. Red Bull, as a leading player in this market, has been at the forefront of promoting energy drinks, which have gained substantial popularity among consumers.

There are concerns about the health implications associated with energy drinks, particularly regarding their caffeine and sugar content. Regulatory bodies have been vigilant in ensuring that consumers are not misled by product labels. This case is likely to influence how other brands position their energy products in compliance with safety regulations.

Industry analysts note that the outcome of this case could set a precedent for how energy drinks are categorised and marketed in India. As consumer awareness about health parameters increases, companies may need to adjust their messaging to align with regulatory expectations.

Next Steps in the Legal Proceedings

As the Delhi High Court reviews the case, further hearings will determine the final outcome. Both Red Bull and the FSSAI will have the opportunity to present their positions regarding the appropriate classification of the drink and the implications of its marketing strategies.

Observers anticipate that the court’s ruling may take several months, during which time the legal teams will prepare their arguments. The temporary stay allows Red Bull to maintain its marketing strategy while the dispute unfolds.

The case epitomises the tension between commercial interests and regulatory mandates, illustrating the challenges faced by both companies and regulators in navigating the modern consumer landscape. The resolution of this issue will likely have lasting impacts on consumer protection laws and marketing practices within the beverage sector.

The Delhi High Court has overturned an order from the Food Safety and Standards Authority of India (FSSAI), which directed Red Bull to cease labelling its products as “Energy Drink”. The decision, announced on September 29, underscores that the company was not provided an adequate opportunity to respond before the FSSAI’s directive was enforced. Justice Amit Mahajan noted the necessity of adhering to the principles of natural justice.

Details of the Court’s Decision

Justice Mahajan’s ruling addressed the FSSAI order issued on June 30, 2026, which prohibited Red Bull from utilising the “Energy Drink” label without a chance for the company to articulate its stance. By setting aside the FSSAI’s directive, the Court emphasised the importance of procedural fairness in regulatory actions. The FSSAI was instructed to reconsider its position and to follow due process in any further evaluations.

Moreover, the High Court has allowed the FSSAI to issue a show-cause notice, affording Red Bull an opportunity to present its case before any new directives are issued. This opens the door for a more robust dialogue between the food regulator and the beverage manufacturer.

Importantly, the High Court did not address the broader issue of the legality of Red Bull’s use of the “Energy Drink” label. This leaves open the question of compliance with existing food safety regulations moving forward.

Background of the Dispute

Red Bull’s challenge to the FSSAI’s June 30 order was initiated following a communication on July 17, which directed food safety officials in various states and Union Territories to take action against products deemed non-compliant with the new directive. The company has been marketing its beverages in India since 2002, using the “Energy Drink” descriptor.

In its legal submission, Red Bull argued that the FSSAI had issued its order without providing a show-cause notice, thus violating the norms of natural justice. The subsequent enforcement actions led to the seizure of Red Bull’s products in multiple locations across the country. The company expressed concern over what it described as a deviation from the FSSAI’s prior recommendations.

Red Bull referred to an advisory issued by the FSSAI in March 2024 that allegedly supported the term “Energy Drink” for caffeinated beverage categories. The company also pointed to an April 2024 press release from the Union Health Ministry, along with a history of licences and clearances that endorsed the use of the same descriptor for its products.

Implications for FSSAI and Red Bull

The High Court’s ruling permits the FSSAI the latitude to reassess its position on Red Bull’s product labelling while ensuring that natural justice is served. As regulatory frameworks continue to evolve in India, this case raises important considerations regarding the balance of compliance, consumer safety, and the rights of businesses within the beverage industry.

As the FSSAI prepares to rethink its stance, Red Bull remains poised to defend its brand identity in the competitive energy drinks market. The eventual outcome could have significant ramifications, not only for Red Bull but also for similar products in the burgeoning energy drink sector.

The case signifies a crucial intersection of public health policy and market practices, critical for stakeholders involved in the Indian food and beverage landscape. Both parties will need to navigate this complex regulatory environment carefully, as they seek clarity on the legal status of product descriptors moving forward.

A Public Interest Litigation (PIL) has been submitted to the Delhi High Court, requesting the establishment of a dedicated system to oversee the safety and well-being of students residing in paying guest (PG) facilities, rented accommodations, and private hostels in the city. This legal move follows the tragic building collapse in Satya Niketan on September 6, which resulted in the deaths of seven individuals, including five students. The PIL was filed by Shivansh Kalia, a second-year student from PGDAV College, University of Delhi, via advocate Ashu Bidhuri.

The legal petition highlights the need for immediate action in light of the Satya Niketan incident, where a structure used as a private boys’ hostel caved in. Reports indicating dubious construction and renovation work prior to the collapse have raised significant concerns about safety standards and compliance with building regulations.

Amidst the aftermath, the Delhi High Court noted during proceedings on September 7 that the accountability for such incidents extends beyond the PG owner to include university officials and local municipal authorities, who are obliged to enforce building codes.

Proposed Mechanisms for Student Safety

This new PIL aims to address these issues by proposing the formation of Student Accommodation Advisory and Monitoring Committees at various levels, including college and university. The petitioner contends that existing responsibilities are unfocused and scattered among authorities such as the Municipal Corporation of Delhi (MCD), the Delhi Fire Services, and educational institutions. Students allegedly lack a single point of contact for lodging safety complaints regarding their accommodation.

To enhance safety, the petitioner suggests that the new committees include a 24×7 helpline, a dedicated email, and an online grievance portal for students. These resources are intended for reporting structural, electrical, and fire hazards, as well as issues related to overcrowding and harassment.

Additionally, the proposed committees would be responsible for periodic inspections of PG accommodations, collaborating with competent authorities to assess structural and fire safety, and identifying unsafe premises for appropriate action. The petition also advocates the creation of a voluntary database of students living in private rentals, which would aid in emergency responses while respecting data protection regulations.

Organisational Structure and Recommendations

At the college level, the proposed committees would include members from the college administration, students, police, district administration, MCD, and civil society. For universities, the plan includes contributions from senior university officials, police, and student representatives. Similar structures are suggested for major coaching hubs that cater to the student population.

The petition highlights the necessity for safer and more affordable institutional accommodation and recommends that these committees advocate for enhancing the capacity of university hostels. This approach is particularly pertinent given the high demand for student housing in Delhi.

As part of the interim relief sought, the petitioner has requested immediate action to create a nodal mechanism for managing student complaints and facilitating coordination among various authorities. This includes urgent safety assessments of private accommodations where students reside, especially in areas of high educational activity.

The legal action names multiple respondents, including the Government of NCT of Delhi, MCD, Delhi Police, GGSIP University, Delhi University, and other significant educational institutions. Ultimately, the plea calls for the formation of the proposed committees and the development of a comprehensive framework to ensure student residences meet safety, hygiene, and security standards.

The Delhi High Court has mandated the removal of a morphed image that allegedly depicts a woman alongside Prime Minister Narendra Modi. This decision comes following a complaint made by the woman against members of the Cockroach Janta Party (CJP), who reportedly circulated the image during a protest. The woman informed the court that she faced online threats, including rape threats, due to the misuse of her photograph.

During the proceedings, Justice Girish Kathpalia ordered police protection for the complainant, instructing law enforcement to keep her address confidential while ensuring her safety. The court clearly stated that her personal information should not be disclosed publicly, acknowledging the potential risks involved.

The court has also issued notices to notable CJP leaders, including Saurav Das, Abhijit Dipke, Ashutosh Ranka, and Ratna Singh. They are required to submit their responses to the court within two weeks regarding the allegations made against them.

Details of the Allegations and Court Orders

The woman’s petition alleges that her photograph was used without her consent to create an offensive image, depicting her alongside PM Modi. It is reported that this altered image was showcased on banners at a CJP rally, and that videos featuring the image circulated on social media platforms. Furthermore, the woman claimed that similar morphed images of her were visible on pornographic websites, leading to significant distress and harm to her reputation.

In response to these serious allegations, Delhi Police informed the court that a First Information Report (FIR) had been registered on the previous day. The police asserted their commitment to addressing the matter expediently and effectively. In line with the court’s directives, they are expected to file a detailed status report within a week, outlining the actions taken in connection with the case.

The court directed the woman to provide investigators with any relevant images, videos, and links pertaining to the case. Authorities were instructed to treat this material with confidentiality and to refer the links to Meta through official communications to facilitate the removal of the offensive content.

Next Steps in the Legal Proceedings

Additionally, the court has taken measures to protect the sensitive information contained within the petition and its annexures. It has ordered that the links to the objectionable content be redacted from the publicly accessible documents, thus maintaining the privacy of the complainant.

The scope of the woman’s case is not limited to the ongoing proceedings against the individuals involved; she has been informed that she can also pursue a separate claim for compensation as the legal process unfolds. The court will reconvene in two weeks to review the progress made by law enforcement and to further address the woman’s concerns.

This case highlights the broader implications of digital image manipulation and the responsibilities of social media platforms in moderating content. The Delhi High Court’s intervention underscores the seriousness with which allegations of this nature are treated within the judicial system, as it seeks to safeguard the rights and safety of individuals affected by online abuse.

The Delhi High Court has issued a notice to Abhijeet Dipke, Saurav Das, Ashutosh Ranka, and Ratna Singh in response to a woman’s petition calling for the removal of allegedly morphed images featuring her alongside Prime Minister Narendra Modi. These images reportedly appeared on social media platforms and during a demonstration organised by the Cockroach Janta Party (CJP). Justice Girish presided over the case, highlighting the necessity for prompt action regarding the petitioner’s concerns.

During the proceedings, Justice Girish ordered the Delhi Police to ensure comprehensive protection for the petitioner, in light of threats she allegedly faced. Furthermore, a status report detailing actions taken on the registered First Information Report (FIR) was requested to be submitted within one week. The court additionally instructed that its ruling be communicated without delay to Meta, requiring the removal of the contested content from their platforms within 24 hours.

Represented by advocate Umesh Chandra Sharma, the petitioner claimed that her images were manipulated using artificial intelligence without her consent, resulting in disrespectful portrayals with the Prime Minister. She further stated that these manipulated images circulated on social media and were prominently displayed at CJP-related events.

Investigation and Response from Authorities

While the court acknowledged that the allegations against the defendants had yet to be examined, it noted that the police counsel confirmed the registration of an FIR concerning the matter. Advocate Sharma indicated that despite this, effective actions had not been undertaken by law enforcement, leaving the petitioner vulnerable to threats.

The court commented on the sensitive nature of the case, suggesting that certain requests typically fall within the jurisdiction of civil courts. However, given the urgency, it opted to address the petition’s requests directly. The court ordered the Delhi Police to submit a detailed report within one week, specifying actions undertaken in response to the FIR.

Concerns arose regarding the accessibility of linked content in the petition, as some web links reportedly did not function properly. To mitigate this issue, the court instructed that relevant links be redacted from the documents filed by the petitioner. It was ordered that all pertinent photographs and videos be submitted to the investigating agency electronically and that the confidentiality of these materials be upheld.

Petitioner’s Safety and Protective Measures

The court also addressed the safety of the petitioner, who had not disclosed her residential address in the petition. A directive was issued for her to share her address with Sub-Inspector Anurag, who would then relay this information to the Station House Officer (SHO) responsible for her area. The SHO was tasked with ensuring complete police protection for the petitioner as adequately as possible.

The court stipulated that a follow-up status report on the protection measures provided to the petitioner should be submitted within a two-week timeframe. During the hearing, there was explicit concern expressed regarding her safety, with the court affirming its commitment to ensure that no harm befalls her in view of the circumstances surrounding the case.

This legal development highlights the balancing act between individual rights, digital privacy, and implications of social media use, as the court seeks to address immediate threats while navigating the complexities of legal jurisdiction in such matters.
