The UK government has announced a ban on pornography that depicts strangulation, suffocation, and incestuous sexual activities in England and Wales, effective from November 6. This new legislation aims to address the growing concerns regarding the impact of such content on societal norms and the understanding of consent, particularly among young viewers. The regulations will apply to any form of media, whether shared online or stored on personal devices, including smartphones, computers, and cloud services.

Scope of the Ban

The ban encompasses a broad range of content, specifically targeting pornography that portrays adults acting as children under the age of 16, as well as sexual interactions between relatives or individuals pretending to be related. Additionally, the legislation will prohibit certain depictions involving step-relatives or foster-relatives, particularly when one participant is represented as being under 18 years old. This comprehensive approach aims to eliminate material that could potentially normalise harmful behaviours.

According to reports, the move follows a review of pornography regulations conducted in 2025 by Conservative peer Baroness Gabby Bertin. The review highlighted the prevalence of choking imagery on popular pornography websites and raised alarms about the potential for such content to normalise dangerous behaviours among adolescents. It referenced an incident involving a 14-year-old boy who reportedly asked a teacher for advice on how to choke girls during sexual encounters.

Baroness Bertin has expressed that the changes are overdue, asserting that the law will convey a strong message to pornography producers and society regarding the unacceptability of extreme content that promotes real-world harm. While non-fatal strangulation without consent is already classified as a criminal offence, the portrayal of such acts in pornography has not been illegal under existing regulations.

Penalties for Violating the Ban

The penalties for violating the new law will vary based on the nature of the offence and the type of content involved. Individuals who upload, post, or otherwise disseminate prohibited material online could face imprisonment for up to five years. Additionally, those found in possession of images depicting strangulation or suffocation, as well as certain sexual acts between relatives, may receive sentences of up to two years. Furthermore, possessing pornography that involves someone pretending to be under 16 could result in a prison term of up to three years.

Justice Minister Alex Davies-Jones has clarified that the intention behind these regulations is not to criminalise harmless sexual preferences but to mitigate the influence of harmful content on the perceptions of relationships and consent among young audiences. She has urged individuals to delete any prohibited material and refrain from sharing it, emphasising that possession or distribution of such content will become a criminal offence once the new rules come into effect.

It is important to note that these restrictions will apply specifically in England and Wales, and will not automatically extend across the entire United Kingdom. This targeted approach reflects the government’s commitment to addressing the issue while considering regional legal frameworks.
